Hello,

I am canadian citizen...got married in february 2013 and since then i have been living with my husband in India...I was in India last yr aswell for 6months....but i only had to stay for another two months because i got sick and my mom had to come back aswell to take care of me and i could not travel until i was well...Will staying here in India with my husband cause any problem in our spousal sponsorship case? Do i need to go back? My lawyer did mention that in the application that I am still considered a resident of Canada and I am merely in India to stay with my husband....Please reply back ASAP....
 
Since you're a citizen, you're allowed to be outside of Canada for the duration of the application, so you're fine.
In the application, you only need to prove that you do intend to return to Canada once the PR for your husband is issued - but if you're still considered a resident, then it should be fine. That part will be assessed during the first phase - stage 1 - and it's fairly quick. If they need more information about it, you will be given a chance to send more documentation if needed.
The fact that you're staying with your husband is actually a good thing in that case : for stage 2, New Delhi will assess if your relationship is genuine. So: the more time you spend with your husband, the better it is. Make sure that it's clear in your application that you are staying in India with your husband until the PR is issued, so there is no doubt about your relationship.

doesn't she need to inform CIC or VO for new address or something? and if you apply for quebec? I have the same case

If she has been living in India Since February 2013, then it should already be in her application, since she is not in Canada.

In your case, if you're planning to spend the rest of the waiting time outside of Canada with your spouse, but you were in Canada initially when you applied, then indeed you should inform your VO - also because it comes as an additional proof. So if you're already out of Canada, or leaving soon, send a "case specific enquiry" to your VO, with an attached document explaining that you want to add extra proofs, and that you are going to stay with your spouse, and include the proofs - for example plane ticket - of that. Also ask for a change of address, but it might be less important if you're already approved as a sponsor. If you're approved, all future correspondence from CIC will go to the applicant, so the fact that your address has changed is less relevant. But you can still inform them!
I'm not sure about Quebec as I don't know their procedure, so I can't answer on that one.

I was in India last year from march to september and then i went back to canada...came back this yr to get married and will leave as soon as he gets his PR....Which part is assessed in first phase? When you get approved from CIC canada as a sponsor ? or do they check all that in New Delhi? I dont want to create any issues....so if i have to go back i will....and if we want to send any letter or something to NDVO how do we send now ?

In stage 1, the focus is on the sponsor: living in Canada (compulsory for PRs, not for Canadians), or intention to go back once the PR is issued, and if the sponsor has some ways to support his/her family. So I suppose that in your application, you have provided proofs of your links to Canada. when did you apply? If you have been approved as a sponsor already, then you don't need to worry. If you're not approved yet, most likely you don't need to worry either! :-) CIC will look at your file, and if they don't have enough information to see if you will be coming back to Canada or not, they will ask for it. It doesn't mean that you need to go back to Canada - it just means that you need to provide proofs that you will come back once you have the PR. Show ties to Canada, letters from family and friends stating that they know you are coming back with your husband, etc.

If you're approved already, then you have your file number and UCI.if not - wait until you have it.

I applied on may !7th and got approved as sponsor on June 6th. They have already transferred the file to new delhi. I dont have work or anything waiting for me but i can try to get a job letter to send to NDVO just to prove that we will be going back. I can also get letters from family and friends saying that i will be going back with my husband once he gets his PR. We have also already mentioned in the forms that I am still in India living with my husband, mother and father in law, brother in law...So do I still need to tell them and show proofs that i am in India ?

If you're already approved, no need to send anything extra - they have assessed you as a sponsor and they believe that you will be coming back, so it's all good.
Same for living in India: if you have already mentioned in your application that you are living with your husband and his family, then you just need to wait. It's a great proof that your relationship is genuine, so most likely you won't have to go for an interview or anything like this.

For now - just sit back and relax, and enjoy India! you're lucky to be able to spend the waiting time with your husband before returning together to Canada as a family.

Thankyou so much Sweden !!! ;D ...i just read some appeal cases on here and that scared the crap outta me..cuz some of the people got rejected even after they have been as a sponsor...they were called for an interview and got rejected afterwards...

Another question -: If we get a PPR ...can they still call us for an interview?

Don't start reading the appeal thread - it's always scary, and remember: you only know what people are posting here, not the whole story. Trust that your relationship is genuine, and that you have included enough proof. Then deal with whatever comes, if it does. Not need to panic in advance. The process is hard enough as it is, don't make it harder on yourself. The vast majority of people are approved.

New Delhi asks for the passport at the beginning of the process, so it's not a guarantee. Some VO (London for example) ask for the passport only when they are ready to issue a visa, but not New Delhi. So - yes, you can still be called for an interview even after the request the passport.

There again - don't worry about it in advance. If you do get called ( well, your husband) for an interview, you will have time to prepare for it, and see if as an extra opportunity for you to prove that you are in a genuine relationship with your husband.
