My gf is so silly... we have to submit our forms tomorrow and she waits until now to tell me she doesnt know if she should fill out this form!


She is from Japan...on a Post Grad Work Permit... she is applying for PR - INLAND.
At the same time she applies for PR, she will send in the change work permit ...so that she can have an Open Work Permit.

On the instruction guide for the application to change conditions guide - it says "STATUTORY DECLARATION OF COMMON-LAW UNION"

We are not going to submit this form because we cant get it signed by a commissionar of the oaths... the PR application that we are submitting at the same time has a lot of proof that we are in a legit 'common-law' relationship.

Will it be okay?

also...one more question... everywhere in the PR application..it says "common-law relationship" but the statutory declaration says "union" ..what do they mean by this? why change the terminology?
 
You only submit that form if you and your common-law partner are co-sponsoring a third person in your family. If you (Canadian) and sponsoring your common-law partner, you do not fill out that form.
 
According to the CIC rules and forms, you don't need to complete that declaration for sponsorship under spousal family class, since there are no co-sponsors involved. We did a common-law application and never submitted one.

HOWEVER there have been some cases i've read on this forum, where people have been asked by the VO during their processing to have this declaration completed and sent to the visa office. I'm not sure if this is a mistake by the VO, or if some particular visa offices for some reason want this form filled out even though it's not required.

So IMO i wouldn't bother to complete for form, get it notarized and send it. But just be prepared there is a slim chance it could be asked for.
