Hello,

I am hoping someone will be able to help me!!

I applied for permanent residency and a bridging open work permit just a few days before my original open work permit expired.
Just yesterday I received a message saying that my application for the BOWP was rejected and I can now no longer work, and must restore my status by the end of August.
Meanwhile my PR application is still processing.

I am wondering if I am able to restore my status as a worker...
My previous work permit did not require an LMIA - so I do not understand if I need one from my current (and future) workplace or not.

Or would it be better for me to apply to change my status to be a visitor, and then apply for a work permit??

Please help! This is all so confusing.

Why was the BOWP rejected?

What kind of work permit did you hold previously?

If it was something like a PGWP, then you cannot restore back to a work permit. You would need an approved LMIA to go back to work permit status. Without an approved LMIA, you need to restore your status to visitor.

I had an open work permit previously.

You need to restore to visitor status.

Unfortunately you no longer qualify for a BOWP since you must be holding a valid work permit at the time you apply for a BOWP.

You need a job offer and approved LMIA to switch back to a work permit (unless you happen to qualify for an LMIA exempt work permit based on your occupation).

You can extend PGWP because of new public policy. It just doesn't apply to him since he had an open work permit.
