Hi guys,

I read on the Canadian Government website that even if my spouse's children aren't accompanying him, they need a health check and we also have to provide their birth certificates. The problem is, although my spouse pays child support, the childrens' mother doesn't let him see them, and will definitely be unwilling to provide their birth certificates and unwilling to get a health check.

What can we do about this?

You must try because Canada tries very hard not to allow parents from excluding their children because situations changes. By not including them they will never be able to be sponsored. If he pays child support he does have some link to the children. Would appeal to the mother about limiting potential opportunities for the children when they are older like attending school or working in Canada. They can be included as non-accompanying which may be able to bring her some comfort. They would still need to be sponsored if they decide they want to come to Canada.

Just to clarify, we are okay with the fact that we might not be able to sponsor the children in the future. Unfortunately, my spouse doesn't have a relationship with his children. Is there any way that we wouldn't have to show the birth certificate or have the children do the health check?

Except IRCC to require proof that you have tried multiple ways to get the children’s documents and do the medicals. Things like proof that you have tried to contact her via email/text, phone, registered letter and even via lawyer. The fact that he financially supports the children means that there is some contact. What does their custody order say? Does he have the legal right to contact or visit his children even if the mother is not allowing it? There are many cases where children not included then wanted to be sponsored so Canada does not allow families not to include children very easily.
