Hi Seniors,

Please I need your advice:

I am a Canada citizen - a single mum of 3 children (all minors) and got married to a widower who has 4 children of his own ( they are all minors) and my income is less than Cda50k. Please I need youR advice on the following:

1. Will I be able to sponsor my spouse to Canada?
2. Will I be able to sponsor his 4 children to along side his application?

Thanks.

Note: There is no low income cut-off (LICO) for spouse, partner or dependent child sponsorships, unless a dependent child also has one or more dependent children of their own. If a dependent child you are sponsoring has one or more dependent children of their own, you must include a Financial Evaluation (IMM 1283) form with your application (see your checklist for more details).

https://www.canada.ca/en/immigratio...tion-fill-financial-evaluation-form-1283.html

you must prove that you have an annual income that is at least equal to the minimum necessary income to support the group of persons consisting of:
  • yourself and your family members, whether they are living with you or not; (4 - you and 3 children)
  • the person you are sponsoring and his or her family members; (5 - widower and 4 children)
  • every other person you have sponsored in the past and their family members, where an undertaking is still in effect or is not yet in effect;
  • every other person for whom you have co-signed an undertaking that is still in effect or is not yet in effect; and
  • every person not included above for whom your spouse or common-law partner has given or co-signed an undertaking that is still in effect or is not yet in effect, if your spouse or common-law partner is co-signing your current sponsorship undertaking.
Federal Income Scales
Federal Income Table, 2018
The following table applies to all provinces except Quebec.

Table 1 - Low Income Cut-Off (LICO)
Size of Family Unit
Minimum necessary income
1 person (the sponsor) $25,338
2 persons $31,544
3 persons $38,780
4 persons $47,084
5 persons $53,402
6 persons $60,228
7 persons $67,055
More than 7 persons, for each additional person, add $6,827

According to the family size of 9 (you and your 3 children plus sponsor widow and 4 children) you must have minimum income of $80709 in order to sponsor your spouse who has 4 additional children that are not your own biological children. You do not meet the minimum as you stated that you make 50,000.

Thank you for your response. But please what if I have savings in my account that is close to that $80,709, do you think they will approve my application or if my spouse has savings to that amount too?

You do not need to meet LICO, so ignore the income levels. You do need to show that you and your partner can support yourselves in Canada without welfare. You can show this through income, savings, family assistance etc.

With 7 children, you should make sure to submit strong financials.

A follow up on my post. I was incorrect to say that you didn't meet the LICO requirement since you are not sponsoring a dependent that also has children. My apology for the incorrect / misleading post. However as canuck said, you would need to show strong ability to financial support 8 people, including the widower without going on welfare.

Things like whether you already own a home that you all could live in could be included as a reason you can support this huge family. Is your spouse earning a good income in his current country? Does he have savings as welll? Does he have a skill that will lead to a good income in Canada? Are his children moving to Canada full-time. Will any of the children require daycare. I would imagine that your budget is pretty tight with 3 children on 50k salary.

@canuck78 ,

Many thanks for the other insight to this my case. Yeah, at $50k, we are managing, but we have some savings. I will consider other points that you raised.

Best of luck it is quite an unusual case and a lot to take on unless your new spouse has good savings and a chance at at a good job. Have you spent a lot of time in person with your spouse? Multiple trips? Have all the children been together? These are some of the things that will be looked at?

Thanks. We have not spent much time with each other because he has not been able to get his visiting visa successfully approved, I usually travel to see him.

Thanks.

That is another red flag. How much time have you spent together over how many visits? Did you get married on your first visit? Sounds like your children have not met the person you married yet.

No our children have not met each other physically, but we speak on the phone and video calls. yeah, we married after our first visit. Then He speak with my children often on the phone

Getting married on the first visit in person is definitely a red flag. Just be aware of the possibility of getting a interview request, especially for the widower since he was the one with a visa denial. Good luck with your application.

There are quite a lot of red flags with your application. Expect a lot of scrutiny.
