I applied spouse open work permit visa in this June and still waiting.... Could you please tell me what I can do? I am really depressed due to this. Also, I have a 5 year old child and I am still waiting for my husband visa results then I want to apply for my child...

Who is applying for what? You are applying for SOWP so what is your husband applying for? Where do you live? Why didn’t you apply for your child with your permit?
 
I am jasvir Kaur and living in Brampton and on study visa, but my study will finish in this mid December. I applied for my husband SOWP visa in June 28, 2021 and biometric done on oct 6, 2021 and medical is also done. I am still waiting for the result of my husband visa application.

I applied SOWPfor my husband through immigration lawyer from Brampton and she said to me, “first apply only for husband, after you got visa of your husband, then we will apply for your son (5 year old).” she said that applying together both husband and son, there are more chance of getting refusal. I am worried about my son because he always cry before go to bed. These things make me mentally sick. Could you please find any solution for me....

There isn’t anything you can do. SOWP processing is around 35 weeks or 8 months (February 2022). You applied close to the end of your studies, and may need to reapply once on PGWP with skilled work and 3 pay stubs. Then apply for SOWP and visitor visa at the same time.

You don’t need a consultant to apply and the consultant you are using is giving you bad advice. You could have applied for both your child and spouse. As others have indicated you usually need over 6 months left on your studies to get approved although you never know during covid times. Do you have a job in NOC 0, A or B yet or have you secured a job for after you graduate?

I am working as a Personal support worker in a retirement home from 10months, but this job comes under NOC C , it’s lot of stress now if I will not get my spouse visa till dec15, I have to quit this job and find any other B NOC that not belongs to my profession ( I am a nurse back home and here a nursing post graduate student)

You need a NOC A, B or 0 to be eligible for your spouse to get SOWP on your PGWP. Again you should not apply for SOWP with less than 6 months until you complete your studies. Wait for the reply on the current application. In the meantime, try to find a skilled position. That way if his SOWP is refused then he can reapply (and is eligible) based on your PGWP and skilled job. He waits again with the long processing times.
