Hello all, I have a friend who was in Canada on a visitation visa. While here he met his wife. They currently live together and been married here for a little over two years. My friend’s visiting visa is expired and so they haven’t registered the marriage with the city registrar.
His wife wants to sponsor him and I have been suggesting to them after reading a lot that they need to apply under outbound sponsorship.
1. is that correct advice seeing that he is still here.
2. What should be placed on the application, common law or married seeing that the paperwork is not with the registrar
3. should he leave the country

4. Beside knowing everything about each other how do you prove common law

1. They can apply inland or outland. As he has no status, he won't qualify for the OWP and could be removed from Canada at any time during the process.

2. No one here knows if they are legally married. That is a pretty obvious thing that they need to figure out themselves.

3. His choice.

4. Knowing about each other is not proof of common-law. Read the checklist and guide.
