Not necessarily. It wasn't until recently that CBSA even had exit data for foreign nationals leaving Canada, as part of the Beyond the Border Program. They also are probably not even aware that he was working illegally, but the OP's possible future husband still needs to be truthful about both, if she decides to sponsor him someday.
 
Because of his immigration history in Canada, I would be prepared for longer processing times and likely an interview. I think you can expect that CIC will examine your application more closely based on his illegal stay and work here. They will want to confirm this isn't a MOC. Make sure you save plenty of relationship evidence in the event he's called for an interview - again, I think the chances are high.

Also, he must declare his immigration history fully and honestly in his application. Attempting to hide anything will create even bigger issues than he has today (potential for misrepresentation finding and a 1 year ban).

CBSA has had access to at least some exit data for a while now. They had my husband's exit data back in 2010 (they quoted departure dates and destinations off a computer in secondary inspection). Agreed they may not know he worked illegally - but obviously he needs to be honest.

The guy came here, overstayed, worked illegally here. . Guy could've picked from thousands of women from any country in the world, but out of 180 some countries, chooses a Canadian.

The red flags here couldnt be more clearer, even you guys know it despite not saying so. Just trying to prevent another sad story seeing as how condition 51 is no longer applicable

your right about that but how about gut feeling or she moves to dubai and love with him there

I think indeed you should have a good representative (lawyer) to help you with the case!! And as others said prepare lots of evidence, pictures, trips, chat logs, cards you wrote to each others and everything like this in case you will have an interview (which I assume is highly possible)...

Thank you all for the replies and advices. We have know each other for over 6 months now, we talk regularly and I will be visiting him next month. As we have decided to get married next year and we do that is, should be disclose about his overstay and working illegally in his background and history form? Or should we retain the right to ourselves ? I spoke to a lawyer, he stay the CBSA or CIC will not have a record of him leaving the country which he did last year and CRA won't know that he worked illegally as he never filled for his taxes. More information on this subject would be greatly appreciated.

you have to be totally honest with them we used a rep and she's is good pm me and I give you her number she's portugese Canadian and doing this for 30 years

You need to be 100% honest. Assume CBSA knows more than you think they do. If you omit or misrepresent anything - you're flirting with a misrepresentation finding and a 5 year ban from Canada. Lying in your application will also create greater concerns this is a marriage of convenience.
