I am a U.S. citizen and my husband is a Canadian citizen. He lives and works in Canada. Orignally we had planned for him to sponser me outside of Canada and I would stay there so that it would be faster. We do not want to live apart for such a long time so have recently considered applying from within Canada. I've been told that if I apply from within Canada that I will not be able to return to the US for visits? Is this true? i was told that I may not be able to re-enter Canada if i leave, and that I would have to re-submit my entire application from outside of Canada. Any help or advice would be appreciated.
 
there are two types of applications - Inland and Outland. For US citizens, the BEST option is to apply OUTLAND as it is significantly shorter. As an outland applicant you can be IN canada when you submit your application and during the processing. Your status will remain "visitor" until you receive PR approval. You can not work in canada or go to school. You can work remotely for a US company or take classes that are not part of a program that is 6+ months. You can travel freely between canada and the us during the process as well. You can even "land" without having to go back to the states by "flagpoling" at a land border. You will be able to bring belongings over at a later date.

bottom line... APPLY OUTLAND! Enter as a visitor, travel back and forth when necessary or stay in canada the whole time by applying for a visitor extension to get you through the process.

RCohen, can't you apply outland even if you're in Canada under a work permit?

I just read your reply and panicked as my common-law spouse is American, we applied outland under the advice of many forum members here, however he is in Canada under a work permit (the NAFTA visa)... Will we be rejected for this?

of course you can! a us citizen can apply outland even if already IN canada on a work permit. I was referring to the OPs situation, which is completely different than yours. Most us applicants are not already in canada on a work or study permit, so they will only be able to enter as a visitor. This isn't to say us applicant's can't enter canada on a work permit and apply outland, it just means the OP will be a visitor and they can not work legally without the proper authority (such as the work visa your spouse has or PR status). Your application is not going to be "rejected" because your spouse is in canada legally on a work permit and applied outland. One thing has nothing to do with the other.
