HI GUYS,

I came in Canada 4 years ago as student , got open work permit after studies( Expired in 2015) ,in Dec 2014 i got married with a canadian citizen. she sponsored me in july 2015 and last month i got approval that my application is approved and they asked me for a police clearance certificate from india for further processing .i applied for that and waiting for it. after our marriage we got a kid who is almost 1 year old, now my wife starts fighting about money and other stuff, for her trust i transferred all i have in her account . now she is knows that i don't have enough funds, she is threatening me that she is going to withdraw the application and i think she can do that. In case she withdraw the file what will happen , will they depot me right away.. i don't wanna loose my kid. please help me as best as you guys can.. thanks

She can withdraw the application at any time. This is her right as your sponsor.

To answer your other questions, you'll need to tell us how you applied (inland or outland). If inland, do you have an open work permit?

I applied as an inland, and applied for an open work permit with sponsorship application, but didn't get work permit so far,, because i applied for a work permit before my old work permit expires so i'm under employment status and can work.

In that case you would unfortunately be out of status as soon as your application is withdrawn and would have to stop working. CIC would then send you a letter notifying you that you have to leave Canada by a certain date. If you fail to leave - this will eventually turn into a deportation order.

You may want to start looking at what it will take to qualify to immigrate independently (e.g. as a skilled worker).

You could also look into an H&C application - but of course there's no guarantee of success.
