Hi,

My wife is a Canadian citizen and we recently got married in India (Aug 2012). I (husband) work in the middle east (OMAN) as a Mechanical Engineer.

Now I am aware that spousal immigration processing time from New Delhi these days is 9 months and if I were to apply from Abu Dhabi it would be 24 months. As I am working in Oman, I am expected to apply from Abu Dhabi. But as I am an Indian citizen, I am guessing I should be allowed to apply from New Delhi too. If I apply from New Delhi, my processing time will be a lot lesser than applying from Abu Dhabi.

Can someone advice if I am eligible to apply from New Delhi or not?

FYI: As I don't work in India at the moment, I do not file taxes there, so will New Delhi's Canadian embassy ask for Indian Tax papers when I file for Immigration from there?

The difficulty with you applying through New Delhi is that they request the applicant's passport immediately on receipt of the application, NOT when they are ready to issue the visa. It is also illegal to send an Indian passport internationally via couriers. Therefore, you would need to return to India to submit your passport when it is requested, and as you would not have a passport, you could then not leave the country to return to Oman. Unless the Indian government issues more than one passport to the same person, you would be without your passport until the visa is issued.

Additionally, even though you may select New Delhi for processing, if you decided the above scenario was not impossible to get around, they could still send your file to Abu Dhabi to maintain processing integrity. This is because there are specific requirements which must be fulfilled by residents of the region in order to obtain PR visas, including submitting a letter of resignation, an employer's acceptance of the resignation, proof of cancellation of work/residence visas, and proof of final notice payment.

I am curious to know how New Delhi handles spouse PR cases if say the spouse was not working (like a house-wife), so there would be no requirement to submit documents like Indian income tax papers, letter of resignation, an employer's acceptance of the resignation, proof of cancellation of work/residence visas, and proof of final notice payment etc.

I could pretty much quit my job, move back to India, apply from New Delhi and wait there until my papers are processed. There is no requirement for the spouse to be working to be considered for Spousal PR Immigration right?
 
Correct, you do not have to be employed during a spousal application.
