hello i am asking for a friend....
She is a work permit holder and married to a spouse outside canada who applied with FSW program and got banned for 5 years for misrepresentation of info. I know she is automatically banned because they share the same last name. she has a baby who is a citizen who she took home for holidays to spend time with the spouse since he was banned and she left because she still has a valid work permit till october of 2019... i will like to know if she would be let back into Canada from this short holiday, and what steps she can take to help her regain her stay here in Canada
 
Bans are individual. She can enter Canada as long as she has a valid TRV. She needs to extend her status like anyone else if she wants to remain in Canada like applying for a new work permit.

so even if he included her in as a spouse...n she is included in the application as a secondary applicant with their marraige certificate to show for it

A ban is a ban. He can’t apply until the ban is up. Not sure buy but you may be able to include him as a non-accompanying dependent. Someone else may be able to answer.
 
What was the reason for the misrepresentation ban? Who received the letter?
My friends spouse .... shes the one with a work permit and her spouse has never been to Canada, also her husband included her in his application so we were told the ban affects her because they have the same last name...just wanna know if shes affected by this because shes currently out of the country for holidays....i am just worried they wont let her back into canada to resolve this even though she has a valid workpermit till oct this year

An individual with a valid visa will be permitted entry into Canada, subject to the satisfaction by the officer at the port of entry that the individual will comply with the terms of the visa.

However, if a family member is inadmissible on grounds of criminality, immigration, medicals etc, then the entire family will be inadmissible for the Permanent resident application.

ok so she just inadmissible for permanent residency not renewal of work permit or trv...so she wont be sent back not to board the plane or to come into Canada???

A lot of times I suspect that an unlicensed agent is posting questions.
