Hi

I am sure this may have been covered before :o. Here is my situation:- Born in Vancouver Island, came to UK with parents when I was little and have stayed some 45 years. Now want to return to Canada with my husband of 9 years. I have a Canadian passport. I understand that I can sponsor him. We shall be visiting Calgary in May with the intention of returning for good. Now Obviously I shall have to get a job once I arrive this also will prove that I can support my husband until sponsorship application starts. My worry is what do we do once we arrive at the airport? Do we go to the immigration desk/people and explain our plans and that we shall be living with friends? Do I start my application for sponsorship then and there? Don't want to start it in UK as we will obviously be in Canada. Husband will want to work asap will he be able to? Will I be able to too as I have been away for so long?

Hi,

You, as a Canadian by birth can live in Canada...your husband cannot...yet. Saying that you will both be living with friends before he is legally allowed to live in Canada is not a good idea. He can, however `visit' ;) those friends for as long as his visitor record allows.

Why not start the process now while you're in the UK? Filing an Outland application from the UK is allowed if you are a Canadian citizen living abroad with your spouse. This way you would be able to show proof of your sponsorship application, if needed, to appease the border officer. Stating that you have an application to sponsor your husband, along with his application for permanent residency, can help coax the BO to issue a lengthy visitor visa.

You would be permitted to work the minute you return (assuming that you do in fact have your SI number). Your husband will not be able to work unless he finds an employer that is willing to jump through the LMO (Labour Market Opinion) process. Otherwise, he would have to wait until he has his PR, which could take less than a year if you apply Outland through the London Visa Office.

If you are currently married and living in the UK, it makes almost no sense to not do an "outland" application through the London Visa Office.

Your husband will not be able to work until either he gets a job outside of PR sponsorship, you reach the end of stage one (AIP) if you go "inland" or he gets his PR via the "outland" route.

He cannot work as a visitor. In fact, he cannot actually "move" to Canada until he is a PR. He can only "visit" and hope that the visit extension is granted.

Unless you have absolutely pressing reasons to be in Canada from May onwards, in your position, I would reconsider.

I have read the application forms but they require my employers details and address. Well until I get a job there I have no details. So to be able to get the ball rolling I would surely have to get employment first, this is why I thought it would be better for my situation to apply for the sponsorship there as I would have an address and employment. So would it be that I can return and get a job and my husband can come with me but only on a visitors basis?

If your spouse has reasonable job prospects, CIC will not actually block your application just because you don't currently have a job in the UK. There is no actual financial requirement, but common sense indicates that the Visa Officer would like to be happy that you will not founder on your return.
 
I dont think there is a minimum $ requirement if you are sponsoring your spouse! however if you have dependable children, the matter is different. Hence you dont require to get a job. In the application, they need to know what you have been doing, hence there is lot of questions regarding education and employment. They also would need Option C printout to verify that you are not collecting welfare from the state.

But you do need a address, from where you can file the application and where the approval and other notification can be sent to.

Yes, you can be returning and your spouse should be visiting friends until the application is approved etc.

You don't need employment in Canada, and you don't need an address in Canada. You can start the outland application with your address in UK, and just update it to Canada when you eventually get here. Even if both of you come to Canada, your application would continue to process in London, and they can mail you COPR directly to Canada once the PR is approved.

For employment, you can include your employment details from UK, what type of job/salary you or spouse expect to get in Canada, if family will help support you financially in Canada if required, etc etc.
