I have a question..

I'm planning to sponsor my husband (US citizen) and working permit status and It will expires on August 2014 and I'm a Permanent Residence here in Canada.

I'm pregnant My due date is on May 2014 and I quit my full time and work as a part time because of my pregnancy. I got miscarriage last year due to high level of stress that's why I'm working as a part time now

My question is:

Since I'm working part time, I may not be eligible to sponsor my husband? Or I could still sponsor him?

Is there any other options I could apply for him to stay more longer here in Canada? Like applying here an Open work Permit

Thanks for all your advice and help.

For sponsoring a spouse, it is not mandatory to meet the Low income cut-off. You could sponsor your spouse even if you were not working. All you need to show is that you (along with your spouse) have the intention to make Canada your long term stay of residence and that you both have skills to take care of yourselves. So to answer your first question, do not worry, you can still sponsor your spouse.

As for your second question, when you apply to sponsor your spouse, also include his open work permit form. Once this is submitted, he is on - what is called as "implied status" - which means he can continue to live and work in Canada.

Actually if you didn't submit husband OWP with application, he would still be able to work under "implied status". The catch is that he cannot change employer. He is stuck with current employer for the entire duration. If you do submit OWP, he will be able to work for any employer once he has gotten OWP status.

Yes, it should be in the same package. In addition to that, you need to mention in your covering letter that you have included the OWP application.

I read in some thread that I could either choose to apply Inland or outland.

what is the best thing to do?

If I will apply for "OUTLAND" is that ok since both of us lives in Canada?

Yes, it is absolutely OKAY to do so. However with an "outland" application you DO NOT have the option to submit an OWP application along with your application for PR, nor would any form of 'implied status' kick in under any subsequent circumstances.

Also, just beware not to refer to him as "living here" when speaking with any customs/border official, get used to saying 'he is just visiting', until he is granted PR status.

Oh i get it.

Thank you. I guess I will apply for inland even it takes longer. Maybe it will be complicated since his status here in Canada is working permit.

I will apply him OWP so he can work in any employer and do two jobs at the same time.

Thank you again!

another question

I can't find the link for application package form for OWP..

Is there anyone could help me or give me link?

Thank you so much

Application to Change Conditions or Extend Your Stay in Canada as a Worker. I chose "A work permit for a new employer", so when the OWP comes your husband can work for other companies if he wishes.
