Hey forum members,

I am in a situation where I am staying out of Canada from past 1 year and got married just a month back. I got my PR in June 2014 and left Canada in December 2014. Now I am planning to apply for my wife's PR. I did read that I have to be in Canada if I am a permanent resident in order to be eligible for sponsoring my wife.

Now the part where I am confused is that I am still working for the same Canadian company that I was employed with when I left canada. We had a mutual agreement and I am doing work from home here in India. I have pay slips and T4 as well. I pay taxes in Canada. I will be providing all these info when I file the PR. So in this case with the 1 year leaving outside of Canada create an issue for me? How do they know that I havent been residing in Canada when I show them the payslips and Notice of assessments (tax returns).

Is it safe for me to file the PR for my wife or should I go back to Canada and than file for her PR. The reason why I am thinking of filing the PR right now is because I want start the application and once I get AOR I want to file my wife's dependent visa so that she can come with me to Canada and than we can be together while we wait for the PR for 12-14 months.

As a PR, you must be IN Canada to sponsor your spouse. They ask for a list of residences if you've lived outside Canada. You would have to indicate that you have been living abroad, and are still living abroad. If you don't, that's misrepresentation and grounds for refusal.
 
Nothing weird about it. Forum member 'doost' just had his wife's eligibility to sponsor reversed because she chose not to remain in Canada while sponsoring her husband. Now they will have to start all over again. You want to roll the dice, prepare yourself for the outcome.
 
You should expect your file to be refused if you apply from outside of Canada and/or remain outside of Canada while the application is being processed. Your work situation is irrelevant. You must be physically in Canada to sponsor a spouse as a PR. Expect CIC to request proof that you are physically in Canada. You won't be able to provide this proof. Additionally (unless you want to commit misrepresentation in your application), you'll have to list your current residential address as your address in India.

I'm not sure what you mean by dependent visa. There is no dependent visa for the situation you are in. Dependent visas apply to foreign workers who want to bring their spouse to Canada. You are no longer a foreign worker.
