I am a Canadian Citizen since 2008. When I have landed in Canada in 2003, I was engaged to my current wife. My sponsorship application for my wife was rejected because we have completed our religious marriage in Jordan during the engagement and that was considered a marriage although we never lived together but I did not declare it. Considering my wife was considered a person I cannot sponsor, under subsection 117(9) d, her application was rejected. I appealed the decision and then withdrew the appeal after 2 years.

Would a new marriage in a different country solve the problem? Someone proposed a divorce and remarriage and I was not keen on it.

Nope, never method would work. You sponsored, she was found not to be in the family class, you abandoned appeal. It is all finished.

Can I do anything to fix the situation? Should I re-apply? Can I apply for my kids on their own although they were born before I became Canadian?

If the children were born after you became a PR then you can apply for them. You could try a H.& C. application for the spouse,. but I wouldn't hold that much hope.

Thank you for the feedback, can I apply for my children alone without being asked why you want to bring your children alone?

Will the children have to live 3 years in Canada to get their Citizenship?

Hi PPM,

I have a similar case. I migrated to Canada under independent professional category in year 2000. I became a Canadian citizen in year 2003. I was in a relationship in since 1990 that resulted into 2 kids. But the I was not married to this lady and at the same time I was responsible to financing and taken care of these kids. After I became a Canadian I went back home to married this lady under the Civil law marriage. The ceremony was attended by both the family and traditional marriage and Civil law marriage was conducted.

In 2004 I filled outland application for PR and she was refused because the VO did not believed there was a genie marriage between us. I did not appeal. In 2005, I moved to the US to work. With my US work visa, I was able to bring her and her dependent children to US. Due to US economy we moved back to Canada. I was able to get Visitor visa for 3 years. . Will I be able to sponsor her and the dependent children under Inland spousal application for PR ?

Hi PMM,

Thanks for your reply. I have applied for inland PR and its over a year now I have not heard any update from CIC. No AIP but was able to get an extension of another 1 year for their TRV Visa.I called CIC the only song they sing is "IN PROCESS". What can I do ? Please advise.
