Hi everyone,

My father-in-law is not interested to come to Canada but mother-in-law is interested. Also, our income matches $40k for 2013. So, my questions are as follow:

1- Can we sponsor only mother-in-law and leave father-in-law out of the application?
2- Does the 5000 cap application process start in January 2015? If yes, what year of NOA do they need? 2013? because no one can have NOA for 2014 by January of 2015.

You will have to list your father in law, I believe, if they are still married, but he can be listed as non accompanying, I believe.

I don't know about when they will reopen with a 5000 applicant cap, but you send the option C assessment that you have most current. If you apply in January, you definitely won't have it for the 2014 season, since taxes won't have been completed yet.

You must include father-in-law in the application, and he will be counted towards your family size.

If you apply in January 2015, you must show NOAs meeting parents LICO amounts for your family size, for 2011, 2012 and 2013.

Note that for 2013, parents LICO for family of 4, is around $55K. If you don't qualify based on 2013 income, then you'll need 2014, 2015 and 2016 incomes ALL meeting LICO, so can first plan to apply in January 2018 (under current rules).

Thanks for the info. So, what if the LICO increases in 2017 and then CIC will request $65k for example for years before? There is really no way to plan for this.

If in 2017 the LICO amount is $65K, then you will only need to meet that with your 2017 income, NOT for previous years. Your 2016 income must meet 2016 LICO, 2015 income needs to meet 2015 LICO etc etc.
 
Not only do you have to meet the LICO of the 3 year prior to parent sponsorship, you also have to maintain the annual LICO for the entire duration of the PR sponsorship until your parents lands as PR. CIC will likely be asking to provide Option C printouts for the years during the PR process at time of parents' landing. If CIC sees that you missed one of the annual LICO requirement, they can deny your parents' PR status.
 
How is LICO calculated from option Cs? That is, is it the total amount the employer paid, the net amount you receive after tax deductions etc?

The total amount income received before any form of deductions are made, in other words, your gross income. Your income before mandatory deductions like Federal tax, IE, Canada Pension, and optional deductions like RRSP deductions also if any.

Thanks for the input. Where can I find the LICO history for those years then? Also, with the added 30% on top where can I get the accurate numbers for 2013, 2012, and 2011 if I were to apply in January 2015?

The LICO requirements for 2010, 2011, and 2013 are still listed in the 2014 PGP guidebook.

Federal Income Table for sponsors of parents and grandparents

The following table applies to residents of all provinces except Quebec. For each of the three consecutive taxation years preceding the date on which the application is submitted to CIC, the sponsor (and co-signer, if applicable) must meet the Minimum Necessary Income, which is based on the Low Income Cut-offs plus 30%.

Actually that just shows 2010,11 and 12... not 13.

I guess they will provide parents LICO for 2013 closer to the Jan 2015 date when program re-opens. Though it's fairly easy to determine the number just by guessing, or finding 2013 regular LICO and adding 30%.

Yes it only provided LICO for 2010 - 2012 but it's a start and CIC will provide 2013 lico once 2015 pgp gets underway. At least the OP has info for 2011 and 2012 to prepare for.
