My girlfriend and I are both students in Canada. I am a PR and she's on a student visa. We're facing a bad financial crunch due to her tuition fees. I'm thinking to preponing our plans to get married. We're 20 and we know that breaking this news to our parents will cause a huge uproar and lead to bad consequences. So what kind of paperwork our we looking at? We have been in a relationship for two years. We have about 800 emails and we a co-signed lease (we're living together). Both of us work, I earn about $1000 a month and she earns around $900. Although I know that there is no income requirement for spousal sponsorship, I wanted to know why spousal sponsorships are rejected and what kind of a timeframe are we looking at?

what country are from? do you plan to apply in-land or out-land?
 
I am an Indian and I'm a PR. My girlfriend is also Indian and she on a student visa.

I don't know wether to go for inland or outland. My mother works for the Canadian Consulate in India (where my girlfriend's local embassy is) and I want to stay as far away from her finding out about it as possible.

Also, my girlfriend wants to go back to India in August next year for a month to visit her parents because by that time it would have been two years since she's been here. I have read around here that leaving Canada after applying in-land can be risky.

What would you advice me to do?

it's a tricky situation. if you apply out-land, your mother will know that right away. if you apply in-land and then your girl-friend leaves, so you might have problems with in-land process. but I think, India will know about your application any way. why not to let your parents know? it's better for them to find out it from you than from somebody else.

Her study visa is valid till 2013 and her course ends only in 2012. So even if she does leave Canada isn't still being a student a valid enough reason to come back?

How does the application process work? We apply here, the application goes to Alberta and then back to India? Also, what is the timeframe we should be looking at?
 
Timeline for inland is 6-7 months to first stage approval and around 1 year for PR if all goes well but you are not advised to travel while inland is being processed. You ask if student visa is enough to get back in, who knows. The IO will know that when she is applying for PR at the same time, she could be a risk to overstay if her PR is denied. That may cause them to not let her in and then you lose your application and she can't finish her studies.

Outland will take 36 days in Missisauga to approve you as a sponsor, then goes to India (make sure you write "hi mom" on the file) and 2-6 months (average 3) is the processing time there, see http://www.cic.gc.ca/english/information/times/international/05-fc-spouses.asp#asia

As the spouse was probably admitted to Canada for 1 year, they can select Buffalo as the processing office.

Yeah, that's a good idea. Apply outland and ask for Buffalo. Then your mom wont find out.

How do I go about that?

So, basically, even though she is in Canada, I select the forms for family residing outside Canada and have her submit her forms in Buffalo?

Also, is there a possibility that we won't get Buffalo as our processing office?
 
Yes, you would pick the forms for outland and in this form: http://www.cic.gc.ca/english/pdf/kits/forms/IMM1344EA.pdf on page 3 there is a 6 a) address where the person lives and you put the address in Canada. Next it asks you in b) if the above address is not in the country of nationality blah blah blah has the person been lawfully admitted for one year and you say yes to that. In c) it then asks you do you wish blah blah and you say yes.

That should get the application sent to Buffalo. You might want to write a cover letter in big print stating WE WANT PROCESSING IN BUFFALO because one couple on here was trying to do this and for some reason their file got sent to the country of nationality instead of Buffalo.
