Hi Everyone,

I'm hoping that someone can shed some light on some doubts that we are having. I have searched the CIC website and I feel like I am just going around in circles.

Here are my questions and thank you so much for any and all information you can provide us.

Note: I am a Canadian citizen currently living in Spain with my Spanish husband.

1) When sponsoring my husband how is my income evaluated? I currently live in Spain and so I haven't had an income in Canada for the past 7 years. Would I need to move to Canada and secure a Canadian income that meets the requirement or can I use my Spanish income? If I have to have a Canadian income when would I be able to apply? Would I have to hold the job for 12 months and show that my yearly income is over the minimum requirement or can I just show what my wage is and x12?

2) We would like to go to Canada at the same time and just wondering what our options are. To apply for PR must my husband be out of the country for the entire time? If he applies from within Canada I know it takes longer but how would that work? Would he just enter Canada as a visitor and then start the application process? Would he then be able to stay in Canada until the application goes through or would he have to get an extention. I believe that Spaniards are allowed to visit Canada for 3 months. Also...if he left Canada...when would he be able to re-enter Canada? For example...if he is allowed to be in Canada for 3 months...could he go to the US for the weekend and then come back to Canada for another three months?

3) If he applies from Spain he can visit Canada...correct? If he applies from within Canada...can he leave the country during the application process?

I think that covers it. I hope that my questions make sense.

1. As spousal applicants don't have to meet the Low Income Cut Off figure, as long as you are not on welfare, just show your spanish income, that will be fine.
2. You include with the application and sponsorship (which are sent to Mississauga) with all the attachments, as statement that once your spouse is issued his visa, you will accompany him to Canada. You should include what your intentions are to where you will live, what, if any efforts made to find jobs.
3. The processing time through Mississauga, 66 days, and 80% of spousal application are processed in 8 months in Paris.
4. As a Canadian residing abroad, you know that you can start the application now?
5. Ordinary visitors, as long as they meet the criteria are usually given 6 months on entry. They can apply for an extension if they wish to stay longer.
6. "In Canada" spousal applicants are cautioned NOT to leave Canada during the processing, as there is a chance they will not be re-admitted, and then they start the application from the beginning.
