Can my partner apply for spouse sponsorship to sponsor me after my TRV has expired and I am waiting for the extension to be approved, and I am at this time considered a TRV "implied status" ?

No - you won't be under implied status if your TRV has already expired. You will still be out of status.
 
Thank you for your answer, but people are considered as "implied status" after submitting the application for the extension of the TRV as seen on the CIC website:


"if your visitor visa expires after you have submitted your application for an extension of your authorization to remain in Canada, you will be considered in status as a temporary resident (visitor) until a decision is made on the application. This is known as implied status."

So, my question is after 1) applied for extension 2) visa expires and waiting for the answer 3) now since I am waiting for the answer I am considered as 'implied status' (until the decision is made on the extension) 4) can my partner sponsor me during this period ?

They can, but here is the catch: If you are applying inland, and your extension is denied, you lose your status and so the in-land sponsorship application is cancelled.

Hi Anastasia

Your partner can definitely apply while you are on Implied Status. When you apply inland and submit an Open Work Permit app with the PR app, the OWP app gives you Implied Status. If you apply for the PR and OWP while on Implied Status from the TRV application and the TRV is denied, you should still be considered under Implied Status because of the OWP application.

You should call CIC to see what they say.
