Sponsoring common law partner

I read that if you were single but in fact married you can never get your spouse since you did not declare them. In this case can i sponsor my girlfriend as common law partner since we already have a son?

The reason why he did not declare her spouse is because after marrying her on 2002 (secret marriage) she went to Japan and since then for a long period of time they don't have any communication at all and found out accidentally from one of her friend that she got married and had two kids already to a Japanese man.
