Hello all,

Some help and advice would be much appreciated. I am going to court shortly to get my children to come and join me and my husband in Canada. They are UK citizens (as am I) and would be coming with me as soon as the case is over. They would be entering Canada as toursits and I would be applying for their PR as soon as we get here. Is this an OK way to proceed?

Do I need to apply for anything in the UK, in terms of entry to Canada for them. I have limited time in the UK for the court hearing and would like to be back in Canada ASAP. Their dad would be moving to China so they would not have a parent in the UK.

Please let me know your suggestions as well as if there are other things I should be considering.

If you expect the court to award you full custody, you need to get papers confirming that. You may be asked to present such papers when they are traveling, and you will definitely need them for the sponsorship.

If the children's father retains any rights of access, you should ask him for an affidavit expressing consent to their emigrating to Canada permanently.
 
I agree with what Charlie said... but are you a Canadian citizen? if not did you include the children on your app for PR and have their medicals?
