Hello Everyone!

I am canadian citizen sponsoring my spouse from India. I normally live in Canada but I came to India on June 2010 to get married. Before coming, I had to make few arrangements and i had given away my lease contract as I could not handle extra expenses. I am planning to go back to Canada on August 2010.

In question 27 in the IMM 5490 (have you and your sponsor lived together?)
Do they talk about the time before marriage? it is a lil bit confusing ...

In question 28 in the same application (are you currently living with your sponsor?)
The fact that I am staying with my husband in india till august (from june to august= 3 months) is it considered as living together? My intention is simply to get married and spend some time with husband; then leave to Canada.

Now this is a lil bit confusing as the same question is again asked in the IMM 5540 (sponsor questionnaire)

For question 27, I just took that as any time between when you started the relationship and when you send in your PR application.

For the other two questions, you should maintain that you are living in Canada but visiting your spouse in India and making arrangements. You should give a Canadian address (a family member or friend) to show ties to Canada, or you could be rejected as a sponsor for not proving that you intend to live in Canada.
 
For question 27 I included the date range of the 3 months my husband and I had co-habited while he was in the US on a visit. I consider that living together. I don't know if it is technically.

You can count from the time you first met up til now.

I'd say 'yes' and explain that you are staying with him while you visit him, but will be going back to Canada on August ___, 2010. Even better if you send in the application after you have already come back to Canada - then you can say 'no'; that way you won't have to prove you will go back to Canada.

Don't say you are living in India for this. You are just visiting and will be going back to Canada. If you say 'no', you will have to prove you will go back to Canada to live, and you run the risk of the visa officer thinking you won't go back, in which case the application will be refused.

For the 'living with' questions, if you are just visiting your spouse, you can answer either 'yes' or 'no'. I have seen applications where the sponsor said 'yes' even though they only stayed together for two weeks after the wedding at a hotel. I have seen others where they have put 'no', and explained that however they did stay together for two weeks at a hotel for their honeymoon. In either case, you have to explain. IMO, 3 months is long enough to say you are or have been living together.
 
I would imagine if you are just visiting, you are not living there. I have visited my husband in Canada for a month and do not consider that living there. My job and residence is here. Since you do not have that, I'm not sure. As canadianwoman said, you are better off returning to Canada before mailing the application to avoid having to prove you will return.

Living together is the entire duration of your relationship. Pre-marriage to current.
