I am a Canadian citizen who has been is receipt of disability for some time. My girlfriend, who is under a 10 year family sponsorship wanted to move in with me.
I inquired with the ministry of social development and they told me i would just have to claim her income after she had moved in. A few months later i was called and told that because she now lives with me, she would be considered in receipt of social assistance which is not allowed and If i were to continue receiving disability every cent I receive they would want repayed by my girlfriends sponsor. I am now in a situation where my girlfriend, who works full time, has to move out if i am to get my benefits.

From what I understand I could sponsor someone myself even though i am on disability, but if somone moves in with me who is sponsored, and we share finances that i will not be able to get assistance.

I was told i can get my disability, but my girlfriend and I would have to sign paperwork that would lead to her sponsor being held accountable for the amount of assistance i receive.


Any advice appreciated. Thank you.
 
I know if your girlfriend received disability, her sponsor would have to pay it back but until now, I did not know that extended to a common law partner.

With the same reasoning, they could say that if you sponsored a partner and you are on disability, when this partner starts living with you, she will be in receipt of social assistance and as such, you as her sponsor would be liable to pay it back.

In the sponsorship agreement, the sponsor is only responsible for the person he sponsors, it doesn't say anything about their future spouses and common law partners. The sponsor could probably appeal that. However, you need deep pockets and a long time if you want to have the better of the govt. Probably best for you not to live together until her 10 years are up. If she was sponsored as a child, it's 10 years or until she turns 25 whichever happens first.

Only other advise I have is check with legal aid.
