Hi,
My Fiancee got his PR for Canada and will be joining his office from 1st week of June,2019....I want to know what is the process for applying for spouse PR from India to Canada....

Hi @nikitajswl0001 - please go to the link above and click on Check your eligibility. Answer the questions and it will tell you if you are eligible. It will also give you a Document Checklist that you will need to follow in order to apply and you will also be able to download all the forms that you will need to fill up. My suggestion would be to go through the Document Checklist thoroughly, arrange all the supporting documents they have asked for, then fill up the forms, print them, put the necessary signatures in (both your and your spouse's signatures) and mail everything together to the applicable address mentioned on the Document Checklist.

You will have to prove that you are in a genuine relationship with your partner/fiance/spouse, so make sure you document all communication. For example, store your Whatsapp/FB communication, hold on to the receipts/invoices if there is any exchange of money between the two of you, keep all your dating/wedding photographs, etc. etc. Once you have taken a look at your Document Checklist, you will have a better idea.

Note that "Fiancé/Fiancée" are not legally recognized statuses in Canada. Only Married/Common-law are.

If you Fiancee "got his PR" meaning only received his COPR and hasn't landed in Canada yet, then if you two get married before he lands, he will need to update IRCC and they need to add you to his application and he cannot land as single. You will need to undergo medical and police check...etc and both of you will receive a new COPR.

So think carefully here.

If he has already landed, then there is no concern of you two getting married after.
Apply as suggested after you got married. (Hopefully you two aren't common-law spouse and he "forgot" to include you in his application)
