My girlfriend and her ex-husband applied together in skilled base from India and her ex was the primary applicant when they applied for immigration.
They got the PR and landed together in Canada. There is no sponsorship showing on her PR card and also in the confirmation of her PR
paper only showing "accompanying family member as her husband name"

1.Can she sponsor me ? (eligibly checking link is not working on CIC website)
2. After applying sponsorship, am I eligible to stay here even after my work visa expire?

1. Yes, she can sponsor you.

2. Submitting a PR app DOES NOT give you the right to stay in Canada. You must still maintain your status.
 
Thanks for the kind reply. After the marriage we will probably apply inland for PR in March, but my work permit expires in December. I heard that it will take an year to get the open work permit. So from December to March(or until I get the open work permit) how can I stay in Canada. What is the best option?

Note: My work permit is a PGWP for 1year.

i'm pretty sure new dehli applicants are seeing 8-10 month approvals for pr. a person can apply from OUTSIDE canada even when they are IN canada as a visitor, worker or student. Though they are not eligible for an OWP, for most outland applicants, they are totally approved before or close to when the OWP would be issued. it really doesn't make sense for most people to apply inland. before setting your sights on inland, i would confirm the current, real time processing for New Dehli by finding the thread specific to that visa office and seeing what the stats are for approval.

also, if you look carefully in the overview section of the inland processing guide, it clearly states that applicants are encouraged to apply through the visa office outside of canada to take advantage of the quicker processing time.

yes. Interviews are hardly a reason to apply inland. for most applicants, the interview is waived. interviews are generally called when there are major red flags in the application pertaining to criminal, dependant or relationship issues. if the application is solid and there is proof the relationship is ongoing, it is unlikely an applicant will see an interview. you would be able to confirm this is true for new dehli applicants on the new dehli thread. i'm pretty sure a majority of applicants are not interviewed.
 
Sponsership Eligibility

Hello everyone!

My boyfriend and I are applying for family common law sponsorship inland application.
New to this, but I was wondering if we need to include a police record check for my home country translated to English? I am currently here on a study visa... Unfortunately my school isn't on the list for designated learning institutions so I can't get an OWP yet - if They would get on that list lets say March would I be ok if I send my OWP in with the sponsorship application next week but get my actual work status after March would I still have implied status?
also I got police record check done in June 2014 for canada is this to old? Same with my medical check which was done in May 2014 ?

Anyone concrete answeres? Would be great :)

Medicals are good for a year but police certificates are only good for 3 months so you'll probably need new ones. I'd get them if possible beforehand so there won't be delays.

Thank you blueanagel you made it clear to me. I have one more doubt,if I apply outland from canada can I go back to India and come back in the meantime. I mean in the time I am waiting for my PR approval...

If you already have a valid multiple-entry TRV, then you should be able to leave and return without issue while an outland app processes. If you don't already have a TRV, it can be very difficult to get one when you have a PR app in process.
