Hello everyone!

I am so glad to find these forums and I have so many questions so I will dive right in.

My American husband and I have been married for almost two years and are trying to decide where we want to immigrate. We are reading up on what is required to apply for his permanent residence card here (we are in Toronto) and what I'd like to know is which is better: applying from the US or from within Canada. He is here visiting (legally) and we are wondering if he should stay for the process or if that is frowned upon. Is it advisable that he go back home and apply from there?

Welcome to the forum! :)

Applying outside of Canada is by far the fastest solution. An applicant applying outside of Canada still can be in the country if he/she has a visa.

Apply outland. If the visitor visa expires during the process, you can apply separately to get that extended. Although depending on how much time he has left on the visitor visa, you might have PR by then if you apply outland.

As for the visa, he just entered the country at the Detroit/Windsor border by car and they said he could be here for up to 6 months.

Can he go back to the US and come visit easily after we apply?

As long as you are applying outland, your application for PR will not be compromised if for some starnge reason he is not let into the country. So while he is here on this trip, try to get all your materials together and apply as soon as you can, just to get the ball rolling. At the expiry of his visitor visa, the two of you take your marriage certificate and proof that you have applied for PR (ie, receipts of fees) across the border and come back through to Canada, stop in at immigration and ask for a 6 month visitor visa just to stay while the PR app is in process. Even if for some strange reason he is denied, it will not harm your PR app any.
