Hi Guys (and gals!)

Was just hoping someone with more knowledge on this subject than me could give me some advice...

I am a UK citizen with a Canadian wife, we are currently living in the UK but plan to go back to Canada. Now our plan was that because my wife is very homesick that she would go back home towards the end of the year to be with her family and i would stay here and basically cut down on all the spending to save enough money to get us set up when i would come over (she would of course find a job once shes back home and save as well).

Our plan was to apply for the spousal visa once she is back home and hopefully would get it and i would be over there for the summer. But having just realized the processing times for the London office (10 months!) it would be into the autumn and not summer before i could come over and get a job.

What i was wondering was if we applied before she left the UK at the end of the year and then she went back home as planned, would that effect the application? Would she have to stay in the UK until the outcome of the application is known?

Also even though i would be applying from outside Canada, if it is going to take longer than the summer, could i come over anyway and just wait it out for the outcome of the application (holiday/vistor visa or whatever i had to take and if i had to take one of these visa's would it interfere or hold up the main spousal visa application?) or would i have to stay here in the UK?

Any help or advice would be greatly appreciated!

She doesn't have to stay in the UK until the process is finalized. I doubt this would have much impact on your application. You can just explain to the VO that she has gone ahead to Canada to get you guys set up and look for work. How long have you been married?

You could come to Canada on a visitor's visa for 6 months and, if necessary, apply to extend it for an additional year. Many here on this board have done that without issue. If you have a return ticket, are otherwise admissible to Canada and have a place to stay, you shouldn't have any problems.

Thats good to know thanks, we have been together just over 3 years and will have been married a year in April
