Hi there.
I read about inbound and outbound.
My fiance is in Canada. I am from NZL. I was wondering, which one is best for me?
Inbound seems like it's the way to go as I can apply for work permit and I'll be living with him (visitor's visa). However, it is extremely long... 26 months on website?!.. And no appeal IF denied.
Outbound however, means that IF a interview is required, both of us will have to travel OUTSIDE of canada to do this, which will cost thousands of dollars that we can't currently spare.

I'm quite frustrated as I'm not sure which one would be better. Of course if no interview is needed for outbound, that would be perfect. But how do we proof legitimacy? We only talk on Skype. We can take plenty of photos of us together when I am there but would that prove anything? That and newly weds are generally more suspected to the CIC for some reason, as they'll see it as a marriage for benefits (aka get in Canada, not in love). If I can guarantee or have a high chance of not requiring an interview, how would I go about that? Outbound does sound the most appealing, even if it means I won't be able to apply for a work permit.

I've read the pinned post for spousal sponsorship here. But should I be worried about anything? I know certain countries are slower or will be more suspected due to suspicion of marriage for convenience, but I think mine is on the clear list as I am also visa-exempt.
Outbound is currently 10 months estimated for NZL. Inbound? 26... It's just so long. Unless if I could shorten that somehow, as I'm not certain if I could even continue to extend my visitor's visa for so long before even getting an approval from CIC for inbound. Just seems extremely tedious of a wait, excluding the fact that IF you handed in all documents and have nothing missing, will it still be 26 months?

You cannot be sponsored unless you are a Common-Law couple (have lived together for at least 365 days, consecutively, anywhere in the world), or...you get married. Canada does not offer a fiance visa.

The processing times are much faster than what you've posted. Inland is currently ~ 16 months (but getting faster) and those from NZ, applying Outland, are being processed in ~ 6 months, according to the latest comments in that thread (Sydney visa office) here.

Sorry ^^; Ponga I meant we were going to be married. I just meant CIC may see it as marriage of convenience as that's what happens when you're newly married and apply right away.. Sorry to confuse..

Apply outland. There is pretty much no chance of an interview unless you have some serious red flags you haven't mentioned.

You are not a Marriage of Convenience risk.

Outland will be around 6 months. You can extend your visitor status as needed.
 
Thank you canuck. We just would not be able to afford a travel to Sydney where I don't have a place for an interview. What are the chances and what are the redflags so I can avoid them? I know they want proof of legitimacy, how can I make sure I prove it well enough to not require an interview?

I wouldn't mind doing the interview actually, but Canada to AUS tickets are over 2000, and that alone does not cover accommodation when we're there. So we wouldn't be able to if we were requested anyways.

Also: is Canada okay with requesting so many extension for visitor's pass?

Being newly married and applying right away is not seen as a marker of a marriage of convenience. It is perfectly normal to apply as soon after marriage as the couple can.
The only thing you can do to lessen the likelihood of an interview is to make the application as good as you can, with lots of proof that your relationship is genuine. An applicant from New Zealand is not going to be suspected of entering into a marriage of convenience anyway, unless there are a lot of red flags. So the chances of an interview in any case are low. If there is an interview, it is only for the applicant (for outland applications).
 
Only the principal applicant is required to attend the interview (if needed).

Red flags are things like huge age difference, very short courtship, different religions (in some countries), also things like a criminal history.
 
So if the couple has not been together for a set amount of time, they will suspect?
Even if only I have to go, it's still very expensive, and I know Sydney is actually quite expensive, in terms of accommodation. So I'd like to not have to go there.

Inland is faster than it used to be, but outland for someone from New Zealand is still much faster. I would apply outland.

What is your relationship background? How did you meet, how long have you been together etc.?

Red flags would be things like a 30 year age difference, speaking different languages, having completely different religion/culture/backgrounds, etc. If you have no red flags, there is pretty much no chance of an interview.

People have extended their visitor status for years while waiting for PR. Provided you can show sufficient proof of finances, there should be no issue.

Sorry, I meant that Outland (Sydney) is ~ 6 months, not Inland.
 
In my opinion, you should get a professional help. Back then, When I applied for spousal sponsorship, I faced some difficulties. I couldn't clearly understand it. So, I consulted an Immigration lawyer, Max Berger to help untie the legal tangles. May be you should ask a lawyer and understand clearly the best options before you. I hope you will unite soon.

Unless OP has some serious issues that they haven't mentioned, there is absolutely no need to waste money on a lawyer.
 
It's been said that you might be spared an interview regardless, but if one is requested, could you not ask for the interview to be performed in Canada at the nearest office given that you are already there on a TRV and would want to avoid the expense? In that case there is really no issue, but someone else may need to confirm that, or just ask CIC about it.

Nope. If an Outland applicant faces an interview, it will be held at the visa office abroad that's processing the application. The exception would be for Outland applications are are being processed in Ottawa (most Americans, for example).
