Hey Guys,

I just created this account for a question. Its my first time posting a thread and a lurker here.

Just a quick background of our situation. My family and I (7 years old back then) migrated to Canada in 2001. We used to live in Toronto for over a year, then right after we had to leave Canada due to unfortunate circumstances. It was not immigration related though it was necessary for my family to leave back then. My father noted that we supposed to get our Permanent Residency within a year, though it was not possible again due those circumstances. It felt like it was a miss for our family and, myself particularly, since we wanted to start our lives in Canada. Despite of this I believe my dad has the IMM 1000 Landing Papers, SNI Card an the Ontario OHIP.

May it be possible for my family (or maybe me) to return to Canada after of years of absence? I am getting a feeling that it would not be possible, but heck I thought it would be worthwhile asking.

Any responses will be appreciated and to thank you for answers. :-)

Technically there's some chance of it being feasible. But no guarantee it will work out - and you and your family will face hardships for several years if you want to try. Best option is to renounce your PR status and apply again from scratch with your family through an economic immigration stream like Express Entry.

If you want to try to retain your current PR status, you would need to use your COPR (landing document) to re-enter Canada by land through a US/Canada land border (you cannot fly in). There's quite a high chance you'll be reported at the border for failing to meet the residency requirement. If that happens, you'll be called to a hearing, will officially lose your PR status and will have to leave Canada. If you manage to re-enter Canada without being reported, you'll need to remain in Canada for 2 years straight (to meet the residency requirement), before you'll be able to apply for a PR card. During these two years, you may find it difficult to get a health care card (your current card is no longer valid) and/or drivers license. Also, you will not be able to sponsor your family for permanent residency until you have met the 2 year residency requirement. So from the time you enter Canada, it will be about 3 years before your family can move to Canada (2 years for the residency obligation and then 1 year to process your family's PR application).

Again, best to officially renounce your PR status and apply from scratch.
