Guys, I have met a woman that was on a work visa in Canada few years ago. I started to date her and everything was wonderful. At some point her visa ran out and she had to renew it. She claims that when renewing work visa she was cheated by some crook immigration lawyer and her visa papers didn't get send to Canada immigration. What to do now? We didn't want her to have to go back to the old country, so she had a suggestion. Well everything was wonderful between two of us and we were thinking of getting married so she suggested that after we get married I should sponsor her and her child. Well I agreed because I really thought this was a woman of my dreams. So I sponsored her and her child. Couple of years later she gets the permanent residency papers. She gets to stay in Canada, we bring her child into Canada and less than a month after receiving permanent residency papers she wants to move out. Well she tried but didn't move out three weeks after PR papers but 8 months later I come home one day and she is gone. Turns out she bought herself her own place and moved out without even telling me. My marriage is done, half of my stuff is gone, what the heck do I do now? Can someone tell me what my options are? What can I do about this situation? Can I claim immigration fraud and how do I do that? Any information appreciated.

Thanks

You should report this situation to CIC if you feel that marriage fraud was committed. Whether CIC sees this situation as fraud or simply a relationship gone wrong is largely out of your control. If you have any, you'll want to provide evidence that she used you to obtain PR status. Details on how to report someone are here: http://www.cic.gc.ca/english/information/protection/fraud/report.asp

FYI: Be aware that because you sponsored her and her child you are financially responsible for them (this is one of the conditions you agree to by signing the sponsorship agreement). What this practically means is that if your wife goes on welfare / social assistance within three years of landing and become a PR, you will have to pay this money back to the government.

BTW: You're using the term "black widow" incorrectly unless she has tried to kill you. I would avoid using that term when you report her to CIC.

Sorry to hear your story, man. But I would definitely do what Scylla has said above.

Thank you guys for your suggestions. Will I need to hire a lawyer? What does the process of reporting marriage of convenience looks like? Will I have to fill out some forms online or will I have to go in for an interview? Also I have heard something about staying married at least 2 years after receiving PR or immigration might have a reason to cancel PR papers, is that correct?

Thank you for your time.

You are talking about the Condition 51 and that was already abolished recently. You can go into the link above and report it.

You don't need a lawyer to report your spouse.

As explained above, the two year rule no longer exists. Liberals did away with it (it was one of their campaign promises).

I think it was abolished this year but it was in effect when I applied for sponsorship, so would that apply to my case?

It was abolished for everyone - including your case.

Scylla, are you 100% sure about that? I mean when I went in to sing a sponsorship papers there were laws, rules and regulations that protect me also like Condition 51 on books that I agreed to at that time. And now you are saying the laws I agreed to at the time of signing would be void? That does not make sense to me.

Thank you for your time.

You don't need a lawyer to report the marriage fraud, that you can do with IRCC on your own.

However you do need a lawyer for the divorce, separation of assets, etc which is all separate from immigration issue.

Effective today, conditional permanent residence no longer applies to anyone

You should know that once you report your spouse, it is completely out of your hands. If IRCC decides to investigate, they will not share any details of that with you.

Yes - 100% sure. Condition 51 has been 100% abolished. You're beating a dead horse.

Effective today, conditional permanent residence no longer applies to anyone, whether:
  • you were sponsored by your spouse or partner for permanent residence, or
  • you were sponsored by someone who had conditional permanent residence (i.e. child or parent).
You don’t need to do anything. We just want you to know.

If you receive your Confirmation of Permanent Residence on or after April 18, 2017 and it indicates that you “must cohabit in a conjugal relationship with your sponsor or partner for a continuous period of 2 years after the day on which you became a PR”, this requirement no longer applies to you.

This says... "If you receive your Confirmation of Permanent Residence on or after April 18, 2017 and it indicates that you “must cohabit in a conjugal relationship with your sponsor or partner for a continuous period of 2 years after the day on which you became a PR”, this requirement no longer applies to you."... On or after April 18, 2017. She got PR papers in September 2016, this law was still in effect. So what's the final answer?
