Hello everyone,


I first came to Canada as an international student. During my time there, I unfortunately made a mistake and was involved in a fight that resulted in an aggravated assault charge. I was placed on probation for one year, which I completed this August.


While dealing with that, I had applied for a Temporary Resident Permit. However, due to a prolonged breathing problem that required surgery, I moved back to my home country. This period was very difficult for me, and I also went through depression because of everything happening at once.


Now that my probation is completed and my health is improving, I want to start fresh and pursue my studies again. My question is: Can I apply for a new study permit from my home country, and do I realistically have a chance of getting it, given my record?


Any advice, guidance, or shared experiences would be truly appreciated.

If you were charged and found guilty then you may be inadmissable under the Criminal Code. Ask an immigration lawyer. If not inadmissable, you can apply but it will be very difficult given your aggravated assault charge. Plus, you didn't complete your Canadian studies so will be difficult to explain why you must return to Canada and study. You want to show that your program is only available in Canada and will give you career advancement when you return hom.
 
If you have criminal convictions in Canada but no foreign convictions, you can apply to the Parole Board of Canada for a record of suspension. You do not need to fill out this application.

You can apply for rehabilitation if at least five years have passed since you finished your criminal sentence.

If less than five years has passed, you can fill out the form and check “For Information Only.” An officer will decide if you can get special permission to come to Canada temporarily.
