Hey folks ,
I became a to PR in 2010 , am right now on my way back to Canada to settle down , i got married here in China in May this year and as soon as i get to Canada i will start sponsoring my wife , we are both from Cameroon , my wife i going to study at a university here for one year and in the meantime she will apply for the Canadian Visa in BEIJING here , but i have a concern , in fact she was admitted to the university for a year 2011-2012 but her residence permit is from September 2011 to July 31st, 2012 which is not up till 12 months or a full year visa /residence , do you guys think that her application will not be accepted to assessed in Beijing because of that fact that it s not at least 12 months ? she is admitted for one ACADEMIC year is that enough to apply in Beijing? MUST she have a full 12 months residence?

If I remember it correctly the CIC states that you are only eligible to apply for for a different visa office other than your country if you have lived legally in that country for the past 12 months. Please check with the CIC website and the Visa office in China for a more accurate and up to date information.
 
Dear friend , i don't know if u are right but i think CIC rather states that one should hold a visa or residence permit for at least one year ,so the number of time you have spent doesn't really count , but how long have u been admitted for , as long as someone has a visa or residence permit of at least 1 year in the country other than his /hers, he may apply even if he has only spent few days there , that's what i read , may be i am wrong though. my problem now is to know if an academic year , instead of a full year of months can be accepted .

Thank you for your comment, in fact i mean she has a STUDY PERMIT (September 2011-July2012), and she will apply for the Canadian permanent resident visa to come to Canada, i will sponsor her as she is my wife and i am a PR since last year .

You are setting in motion 3 things:
1. Sponsor your wife
2. Your wife applies from China for PR (?)
3. Your wife has a valid Student Visa to enter Canada.

Once you sponsor your wife, her PR application is redundant....why would you have 2 application in different category (Sponsorship and Individual PR application)? People do have 2 applications but I think in your case it is not required.

As she has a valid Student permit she can enter Canada on that basis and then you can file a sponsorship application for your wife so that she can get a PR status eventually. Her having a visa for less than a year is immaterial.

NB: Since you are in Canada, you could call CIC and ask them your question or pay a visit to Canada Place for more clarifications.

sorry bro , i think u misunderstood me , i mean my wife has a valid study permit in China from september 2011 to July 2012 , i want her to apply for Canadian PR from China , so i want to sponsor her from China during her study time , my question is:
- will the canadian visa office in Beijing accept her application ? given the fact that her study permit runs from september 2011 to July 2012? it 's less than ONE FULL YEAR? that's my only problem...

Ok...now its clear.

She may not be eligible for applying for PR from China since she is short by a month as against the rule of " Valid entry for a year" but she could apply from her home country (ie with home country as her VO) which would definitely work in her favor.

Thanks bro , that will be a problem then , in fact i don't want her to apply back in our hometown because it's too slow there, 18 months needed for the process , but in Beijing it's just 4 months .My God i need to find a way..

4 months to get a PR from Beijing? No,that's not true. Am I missing something here?

According to my research for Canadian employer the people who have been received university certification in Canada are in priority why you don’t apply for she in Canada?

Beijing office takes 4 months to process such application once they receive the full package from CIC Missisauga , you can check the spouse sponsorship application processing time ,from the CIC website , click on Beijing office and you will see .

Saied 2011, my wife is not applying for a student permit in Canada, rather she is having a student permit in China, THANKS!

Sorry about the confusion....yes for sponsorship its approx 4 months (Beijing)....from your post I thought you were talking about PR application from Beijing.

Thanks bro , but i am reluctant to send her application to Beijing as it may be returned because 1 and a half month will be missing from a chinese visa , not making it one full year. :(
