I recieved ita and now i have serious issues with my wife,if she is not going to apply what can i do
 
What do you mean?

Is your wife the PA?

you can still change your application , hoping your points wont drop and increase and you should be able to explain the same in the letter of explanation, but before doing this call cic and let them know of change in relationship and how to proceed further.
 
Assuming you're the PA - even if you make the change now to non-accompanying you would still require her medicals/PCC/POF.

If you want to change your status to separated - then you will require a legal separation agreement.

Am the prinicpal pa and she is not willing to do the paperwork for her part,points will increase if she wont accompany me and at the same time am not going for legal separation,any ideas

Sorry to say, but I don't think it will work in this way, either you need a legal separation, or you need her to undergo medical and PCC.

The solutions are there - convince her to do the paperwork or get legal separation.
 
Thanks everyone things are complicated now and am runinng out of time will prepare my papers and hope for the best
 
As others have said, as long as she is legally your wife and you haven't started divorce proceedings officially, she must pass the medical and she must provide PCCs in order for your application to be approved - even if she is non-accompanying.

If she won't cooperate, you need to start divorce proceedings or get legally separated.

Hi Scylla,

I have filed a case in India to get divorce from my wife. It has been going on for a year now and sadly not much progress as it is the same all over India. We have been living separately for more than 2 years now.

Can I submit an affidavit stating that I have filed a case and will CIC accept it as a proof of Legal separation??
What are the proofs CIC will expect for Legal separation?

Any help will be greatly appreciated.
