Hi
I was in canada on Student Visa & overstayed there for 2 months.But when i left Canada
there was no exit stamp on my passport. After 3 years I want to apply for Canadian Immigration.
Will it create any problem for me?
 
Yes, overstaying is not welcomed by any country and since you do not have an exit stamp, it will be a negative point in your application, but it doesn't stop you from applying for immigration.

There are many points in that regard :


For students or foreign workers they have allowance period of time for only three months after the expiry date of their legal status to stay in canada and apply for restoration and you haven't exceeded the three months so you are still fine.

since you haven't informed the immigration department about your status when you overstayed for 2 months, they haven't kept any information about that and you didn't get any removal order from immigration canada (no records on you in that regard).



The last point, am currently in canada, one of my friends overstayed for 3 months and he applied for restoration (so he informed them) and haven't recieved any response form them, then he decided to leave the country and he had left to his country saudi arabia, and applied for the canadian embassy there for a student visa again, and they sent him the medical forms without even interview, so till now, things are going very well with him, he is done the medicals and still waiting for his visa. if you want a definite answer, wait for a while and i will inform you whether he got the visa or not.

He got his student visa for 2 years and 2 months form the canadian embassy in Riyadh yesterday without even any interviews, as i told you he overstayed three months in canada after the expiry date of his study permit and he is coming back to canada next week.
