my sister is in canada and her husband was applied for open work permit but visa officer said they are not satisfied that this marriage is real . they imposed ban of five year under section 40(1) for misrepresenting . he can do appeal or there have any solution for this

We would need to see the letter from IRCC. Paste it here with personal information redacted.
If this was part on an "inland" (Spouse or Common-Law Partner in Canada class) PR application, I don't think that there is a path to appeal.
