second application for PR

Hello,

I need some help to apply permanent residency in Canada again. I applied for PR in 1997 as a Civil Engineer and accepted.
Before two months of my departure to Canada, I got married, but decided to go to Canada alone as she had final exam within 3 months.I took lawyers help for my PR and noticed them about my status. They mentioned me to come to Canada and sponsor my wife.

So I followed them and landed to Canada without including my wife as my dependent. I went to the lawyers office and asked them to start process for my wife. They demanded a lot of money from us. So I myself submitted the application of my wife. Eventunally, I received the letter from the immigration that I must declare my status before coming to Canada and I received removal order from Canada Immigraiton. I fought with the immigraiton that It was just an honest mistake but failed to convince them
So I had to leave Canada as the deportation order stayed.

Before I come to Canada in 2002 , I returned my PR papers and I finished all the legal formalities and I checked with Canadian Police If I have any criminal records or not.They said no.Before departure from Canada, He also advised me to apply again If I have points. By this time, I finished second bachelor degree and worked in a renowned Company in Montreal.However, the case officer told me that I require Ministers permission.

Do you think If I apply again, would they accept me?

That's why I am rethinking to apply again.I would be grateful If specialist can reply whether I have any possibility or not.

To apply under FSW1 you need to have atleast 1 year full time work experience or equivalent in 38 occupation list, as per ministerial instructions. I assume you completed your second bachelors degree in Canada, and if you have done it recently, then you may qualify under the Canadian experience class.

Also since you have spent several years in Canada, you may secure a job offer in Canada through your personal contacts.
 
Thanks a lot for an encouraging reply. Recently means, I finished bachelor in Compuere Science from Canada in 2001 and worked in Canadian Avionics since I had come back in 2002 September.

This time I won't take any lawyers help because I am really upset about them. They always try to extend the issue. I would like to choose 0213 Computer and Information Systems Managers . This is my current occupation.

I live in Thailand. Can I submit the application in Candian Embassy Bangkok? What forms to fill up for ministers permit?

You should talk to the embassy about what you have to do for a ministers permit or what else you might have to do before you can apply for PR again. If you want to apply for PR via skilled worker, normally you would send your application to Sydney, Nova Scotia and they will send it to your local visa office after they have approved it.

Your lawyers gave you very bad advise. If somebody applies for PR when they are single and gets married at any point before they land as a PR, same if they have a new baby in the meantime, they need to add the new family members to their application BEFORE landing as a PR. If they do not, it is seen by immigration as misrepresentation. In most cases it does not cause the person to lose their PR and get deported, I think this is the first case I've heard of, but certainly causes them to be unable to sponsor the family member in the future.
 
yes, I also agree with you. This may be the one and only case of canadian Immigration history. Even at the last moment, I belived that I would be accepted.I found few people made mistake like me and they all came to me for suggestion. I found most of them back to their home country and change change their marriage papers. I just wanted to know all of you how much cost I had pay for this, I lost 10 years from my life according to my financial ability.

Since you lost your PR and are applying again from the start, of course you can include your wife and sons on your application.

Not being allowed to sponsor would have been true if you would have kept your PR back in 2002 and stayed in Canada. Then you would not have been allowed to sponsor your wife to come to Canada and she would have had to find another way to immigrate by herself.
