I will need to say yes, correct, my brother spent one year in a county jail for theft of several businesses. He is no longer in jail and recently completed his 10 years of probation.

Will this affect my case?
 
According to me the criminal record is only for your brother, who is NOT included for immigration. So, there will not be a negative impact on your application. Go ahead.
 
So even though he's listed as my brother in another area... that form is for people that are being sponsored... not other people/family.

Not needed it is your brother and he is not listed in the main app.He is just listed as other family members,he is not coming to Canada and even so he has finished his course of action against him.But to answer you question NO
