i have a question..my mom is currently working in Canada and already have her PR..she then applied me and my sister for migration under family class sponsorship and now its already approved i'll be getting my PR card soon.. we will probably be in Canada this coming august as we were just finishing some stuffs like transcripts from previous school..here's the thing i have a boyfriend who is currently working in Qatar and we've been in this relationship for almost 1 year and a half now..on the first 6 months of our relationship we are together, i mean we would go out and do stuffs together then after 6 months he left for work in Qatar..but we still continued our relationship because we really love each other..we would non-stop chat online to reconcile our long distance relationship and talk thru skype call, email each other and i even call him using my landline and cellphone regularly...now that im going to Canada i would want him to be with me there and marry him since its impossible for us to get married in our home country..we've already talk about this and he also wants to marry me if its possible because he also wants to be with me..we're planning to get him a temporary visa so that he could go in Canada and once there we could get married..but its really confusing me with all the posts ive been reading in this site..can someone help me and give advice with my case...it would really be appreciated if you could share insights and ideas about this..

sorry for the length of my inquiry i like to give as much info i have to get an advice with my case..we really love each other so much that the only barrier now is marriage since if it can be done in Philippines then we would have done it there.. :'( :'( :'(
 
Hi, I'm not an expert so someone should add to this, but it seems you could qualify for the conjucal class. You are in country where same sex marriage isn't legal. It's still hard to qualify for this class, though. You will need as much evidence as possible that you are a true couple, so save everything you have in terms of pictures, communication, tickets from visits, etc.

i also get that from a frend of mine but then im thinking of the success of the process..would it be more apropriate if we get married in Canada first then apply him for spousal sponsorship? since we are planning to apply him for a visitor visa so that he may be able to come in canada.. :'( :'( :'( :'( omg i dont wanna be away from him :'( :'( :'( :'(
 
It's very important that you do not marry him until you have your PR because your PR is based on you being a dependent child of your mother and you lose that classification if you are married. Once you have your PR, your boyfriend can apply for a visit visa, come to Canada, get married and get sponsored by you for PR. If your boyfriend can not get a visit visa, you can apply as conjugal partners.

once i have my PR card, do i have to wait for like few days or months before i can tell my bf to get a visa to come in Canada? or can he do that right after i have my PR card? and one more thing, after we got married and apply him for PR also can we do it inland because he will be using a temporary visa?? he needs to go back right? or can we extend his stay? i was wondering if its best to apply him outland or inland though,,,
 
You don't really have to wait after you have your PR. He can apply for a visit visa and if he gets it, you can get married and apply inland and at the same time as you apply to sponsor him for PR, send along a request to extend his visit status when it expires and a request for open work permit when he gets first stage approval. That way, it is all tied together. If you apply inland, it is best that he does not leave Canada at all until his processing has been completed. This is because if he leaves and for some reason is not allowed to return to Canada, the inland application will be automatically cancelled. If all goes well, he could have first stage approval and open work permit in about 6 months and his PR in 12-18 months.

If you choose to apply outland, he can still stay in Canada and request a visit status extension. There would be no first stage approval or open work permit but he would get his PR faster. If his case were processed in the Philippines, it would take on average about 6 months for him to get the PR. The downside of outland is that if they call him for an interview, he would have to go to the Philippines but there is also a downside to inland if an interview is required because if that happened, he would not get first stage approval with inland, he would have to wait until they have time to interview him which with inland can take 1-3 years depending on which office it is. Better make sure your application is bullet proof from the start and hopefully an interview will not be required.

i see..but its kinda confusing...with all the interview...i've read that when the application is done inland and it got denied you can never appeal for it ever? is that true? im kinda worried now.. what do you suggest is the best way for us to apply his PR? because right now im thinking outland is much more practical...i really wanna nail this thing cause i dont wanna get panicked when the time comes that we are already there..
 
Yes, there is no appeal with inland but if inland is denied, your then husband can leave Canada and you can fix whatever caused you to get denied and apply again outland. The only problem is if you had to go to interview with inland, during the long waiting time for the interview, he would be stuck in Canada without being able to work and without health care. Sometimes outland is better. You can apply outland even if he is in Canada at the time you apply.
