Hi Everyone,

Have a situation and would like to have your suggestions and help on the matter.

I am a Canadian Citizen living abroad for almost 10 Years and have applied for my Kids (were Born Before my Citizenship) as a sponsor and tried to assure the authorities that we will be moving to Canada once the application will be approved but it was denied so we also cancelled our plans.

My Wife who have been living with me was a PR holder which has expired but we couldn't go to Canada without the kids and i was told earlier in order to apply for kids i have to become a resident of Canada. Now i am planing on moving to Canada and would like my wife to accompany me (her PR has Expired) but i am sure being a spouse of Canadian Citizen she is eligible to apply for RRP, please advise your suggestions.

For my kids who are now 16 Years and 15 Years please advise if the only option is to apply after becoming a Canadian Resident or can we apply for their Visit Visa or any express entry method has been introduced in the past few years.

The problem must have been that they did not believe you would go back to Canada when your family got PR. Did the visa officer mention any other problems?

Since it didn't work the first time, I would move back to Canada and then apply to sponsor your children. Do it soon, because they have to be under the age of 19 to be sponsored.

Are you sure your wife's PR status has expired? A PR who is accompanying his or her Canadian citizen spouse outside of Canada can count those days as part of the residency requirement.

What nationality are the children?

yes you are correct they obviously did not believe me when i provided them in writing about my plans of moving back. My Chidrens are of Pakistan Citizenship.

For my Wife she has ben living all along with me ever since the PR Card has expired as the process of apply for PR Card was to be in Canada for 3 months and having 2 kids at home it was difficult for us to manage at that time so we never applied for renewal of the PR Card.

Now that we are planning of settling in Canada so I am thinking of applying for RRP for my wife so she can accompany me to Canada and the kids can stay with their Grand Parents till the time Sponsorship application goes through. The problem we foresee is that Sponsorship application can take upto 12-16 Months and that is a long time for the kids to stay with their Grand Parents and other relatives.

Please let me know if the plan that i have defined above seems to be logical to you and if you foresee any challenges i may have not thought of.

Even though your wife's PR card has expired, that does not mean she is no longer a PR. Note the quote on this page from the CIC website: 'If your PR card expires, it does not mean you have lost permanent resident status.'

The above page also has a link to a page that tells you how to determine if you still have PR status.

If she is eligible, she can apply for a Permanent Resident Travel Document; the CIC website has more information here: http://www.cic.gc.ca/english/information/applications/travel.asp

For the children, you can apply for a TRV (a visitor visa) for them. Most likely it will be refused. You can then apply for a TRP (a temporary resident permit), which is for cases like this where someone is not technically eligible to enter Canada, but where the government will let them because of humanitarian concerns. In any case, you can apply to sponsor them once you are back in Canada, if they get a TRV, a TRP, or are not allowed in.

If your wife is really no longer a PR, you can sponsor her once you get back to Canada.

I don't know what you mean by apply for "RPF". She needs to apply for a PR Travel Document to return to Canada.

You must first try for TRVs before being able to apply for TRPs.

Google Temporary Resident Permit and look through this forum. There are lots of threads about this topic.
