Hi

I live in India and applied in May 2009. I heard from Nova Scotia in June 2009. They have asked for making full application to CHC, New Delhi. I would request forum members to give their valuable advice on some issues. I am pretty confused.

(1) Am I required to pay Right to PR fee right now or high commission will ask that on a later stage when they send instructions for medical? Do I need to pay fee for my dependent children (aged 11 and 7 years) too or are they exmpted?

(2) My spouse is a teacher in a government school. Will CHC ask for an NOC from employer? I have not come across any such requirement in instructions guide. In this case, I cannot even provide a reference letter as school authorities will come to know and will themselves press for NOC.

(3) One of the companies I worked in past was merged with another company. My expereince with this company has earned me the NOC vital for success of the application. Although, my supervisor at that company (who is still there) has issued me a reference letter detailing out jobs and reponsibilities, the letter has been issued on letter head of the new company. How do I explain it to CHC? What can be relevant evidence here?

ND Checklist has a point clearly asking for RPRF fees to be enclosed as draft. So, you would have to do it as per the guideline.

2nd part of (1): "Do I need to pay fee for my dependent children (aged 11 and 7 years) too or are they exmpted?" ----> I donot know!

answers to your questions:
1a. You can pay the RPRF at any stage in the processing of PR visa but must be paid before the visa is issued. Therefore, if you wish to pay it tomorrow, go ahead and pay it but as I said, the high commission will write you if you have not paid it and they are about to issue you your PR visa.
1b. RPRF is only for you and your spouse, 11years and 7years children are exempted.

2. You are the principal applicant, reference letter is needed only for YOU, (the principla applicant). CHC will not ask for work experience letter from your spouse so relax.

3. For the 3rd question, you will need to write a cover letter with your documents explaining that your company has merged up and that there has been a change of name in your company, give as much information as you can give, they will understand. A lot of people are in your position too and have been approved only if you give CHC enough information that is available to you with all honesty. The cover letter is enough coupled with work experience letter you have obtained with your supervisor's name, company's stamp, phone number, etc. The CHC will contact your supervisor/company if there is any need to.

"For you and your spouse or common-law partner:
• notarized employment contracts from your present and past employers,
accompanied by an English or French translation
• original and up-to-date letters of reference from your past and current employers.
Letters must be written on company letterhead and show the company’s full
address, telephone and fax numbers, and be stamped with the company’s official seal"

Instructions for Buffalo are also same. But for London, instruction is to provide reference letter for Principal Applicant only.

I am really confused whether it is ok to not send spouse's reference letter.

Did you mentioned in your application that your spouse is employed? I did and sent only appointment letters and recent payslips for her. It worked in my case. I am from India and Visa Office is New Delhi.

in most cases its pretty difficult to get a letter from the current employer for the processing, however in case if u do get it ur very lucky, and in case of your spouse as "Joy" stated, it would work in most of the cases provided you have an explanation documented, stating the risks involved if you ask a letter of experience or anything like that for your processing.so a proper explanation would get the job done in case of not able to provide the exp letters.

Try not to fake things since it might get verified by field officers.....

it is a common perception that the details of spouse is less important. mainly they are concerned with the principal applicant's status at work and history.

seniors should be able to verify.

You as the principal applicant needs to submit reference letters, your supervisor's complimentary card, payslips, address, phone, name of your employer and your supervisor, etc. Worry not about your spouse experience letter.
If I may ask, are you not the primary applicant or your wife the primary? This question needs to be answered by you in all honesty. If you are the primary applicant then my answer above is relevant. If you are claiming points for ADAPTABILITY based on your wife's EDUCATION that's when you need to worry as you will have to send your wife's original transcripts, photocopies of certificates, etc.(Even if you claim adaptability points based on your wife's education, you don't have to submit work reference letter for her, she is not the primary applicant, YOU are!That's why CHC advise that you need to decide between you (husband, in your case) and spouse(your wife), whoever have more points(using the 6 selection factors of:1.Experience, 2.Education,3.Language ability, 4.Adaptability, 5.Age, 6. Arranged Employment) should be the principal applicant.
Worry less,
Be truthful in what you are submit,
Remember CHC will VERIFY!
