Dear Members,

I am writing this to get help and advise on my PR card. I am Indian citizen.

I had immigration visa in 2009 under skilled migration category. I was single that time. I went to canada and returned in a month to Dubai to continue my work in Dubai. I received my social ID and PR card while in canada.

I got married in 2009. However, Due to matrimonial issues leading to divorce in 2016, i could not make to canada as i have legal matrimonial proceedings going back in my home country. I did not returned to my country due to fact that i may be held up due to long delay in matrimonial proceedings and I will loose my job. I moved to Qatar in 2015 from Dubai for another job. I got remarried in 2016 and blessed with two children's born in Qatar. I am presently working in Qatar since 6 years.

Now considering my case can you please advise how can i reenter canada again. As i only stayed for a month in canada and my PR card is expired already.I did not meet the residency obligation days in canada.

I want to move to canada and settle permanently. what are the options available for me from qatar.

Your advise will help me in having a better life in canada for my family including my children born here in qatar.

Your options are as follows:

Option #1:
- Officially renounce your PR status.
- Apply for PR status from scratch through an economic immigration program like Express Entry
- Include your spouse and children in the application so that all of you receive the PR visa together and can move to Canada together.
- This is the most realistic option.

Option #2:
- Travel to the US and then try to re-enter Canada through a land border without being reported for failing to meet the residency requirement.
- If you manage to re-enter without being reported, remain in Canada for two years straight without leaving to meet the residency requirement. Once you have spent two straight years in Canada, you will be able to apply to renew your PR card.
- You won't be able to sponsor your spouse or children for PR until you have lived in Canada for two years and meet the residency requirement.
- They can try to apply for TRVs to enter Canada during this two year period however the chances their TRVs will be refused are quite high.
- For this option to work, you must be prepared to be separated from your family for 3 years (the 2 years it takes for you to meet the residency requirement and then another year to complete the processing of the sponsorship application).
 
You've been away for over 10 years. The chance of you entering from US without beingi reported is very slim. I think option 1 is more likely if you and your spouse has enough points for Express Entry.

For option 2,

1) can you please tell what is "reported at border" , is it that they will not allow me to enter canada from USA border

2) can i enter USA by visit and try land border to canada through another visit visa of canada as normal visitor and not disclosing my PR details at the border.

3) can i go on visit visa directly to canada from qatar and do not disclose that i had PR earlier. Because my passport which had canada immgration visa stamp is now renewed and my new passport do not have any visa.

4) once i enter canada, can i work with my expired PR as i have to survive for all these days.

For option 1,

I may not be able to qualify for express entry requirements as i do not have enough points

Well, so you think IRCC and CBSA cannot connect you with your PR status because you have renewed your passport?
btw. A PR cannot apply for visitor visa. They will/should find out once you applied.

Report at border means they will still allow you to enter but will give you time to appeal for your PR status. Your time in Canada will not count as your RO. And in some provience, you may not be able to obtain things like driver's license or healthcard without a valid PR card. (some may be ok)

Basically, there is no point of staying in Canada even if they allow you in because I do not see much H&C reason to appeal for the PR status.

Just to comment on your pt 4, you need a valid social insurance number in order to work in Canada. To apply for the number, you need a valid PR card. You might want to make money on other means such as stock trading.

1) you will be allowed to enter Canada but will need to appear at a hearing to argue why you should be allowed to keep your PR status
2) not possible - you can't get a visitor visa as a PR
3) see above - not possible - you are in the system as a PR and a new passport doesn't change this
4) you can work as long as you have a SIN
