Me and my soon to be husband are going to be married in April, my return date is May 10th, is there a waiting time for when I have to come back to Canada? Or can I come back the next week? Will they question me about my visit? Will I be denied?

Also I've been here for a little over 5 months, but not quite 6, [as of May 10th] if I were to apply to extend my stay [which would be my 2ed time from when I arrived.] what are the chances of me being denied?

Me and my husband are trying to apply for sponsorship and PR for me, I'm not sure what to tell immigration so they will allow me to stay so I can finish the sponsorship/PR process. I'll be getting my medical exams soon and I'm waiting on my police/FBI certificate.

Any tips on my situation?

please, and thank you in advance.

You could attempt a crossing the next week but not sure how likely it would be to just get in. That all depends on the immigration officer. I personally would apply to extend my status after filing for PR in April. Submit the application with proof of the PR application. If nothing else you would be on implied status for several months and then if they refuse you will just have to leave and wait out the rest of the time stateside which would not be that long for PR approval from the US.

I thought implied status didn't work with PR outland :(

which is what we plan to do.

No if you apply to extend your stay beyond six months you are on implied status while they make their decisions. If you mail it in before May 10th there is at least 142 days or so for them to make a decision to extend you or not.

In your application to extend I would definitely include your plans to file for your PR as soon as you receive your FBI. include a a copy of your receipt of payment so they know your serious and all additional documents and you should be fine!

Hi raffelone:
This is what my husband and I did since we were totally unsure of what to do. I'm a U.S citizen origianlly from California.

My friend and I went over the border, I live near Niagara Falls so its very easy to go across-generally. We asked about me getting my first visitors record and the IOs there were actually very helpful and told us exactly what to do. I was "visiting" fiance/hubby getting ready to get married. My hubby had to be with me to apply for the 1st VR and to bring all our documents with us. So we did that, we went into NY, spent the afternoon there and came back. We explained to the border agents what we wanted, the filled out a yellow paper and sent us to the Immigration office. The IO that dealt with us said we could come back to their office to renew my visitors record but I needed to bring all my documents proving that I was making progress on our application. As long as they were convinced we were working on it and not lollygagging. When it was time to renew , ever-loving-hubby and I went across the border again, came back , told Canadaian Border agent when we wanted, she sent us over to the Immigration officer and with all of our documents saying yes we sent in our app. ect, they renewed my VR for a year. If you live near the border they IOs may be understanding, and hopefully will be professional about how they handle everything. Just make sure you have documents, receipts and anthing else you think you need to prove you are doing the right thing.

Hope this helps! Good luck to both of you.

BTW sorry if this is a little non sensical, I've been drinking Mimosas all day so I'm a bit tipsy.

okay thank you guys, I've receipts and banks statements that show that I've payed for my fingerprints [and receipts for shipping it out] and soon I'll have the receipt for my medical exam(s). So if my bank statement shows that, I'll pretty much be fine along the lines of prof?

it would also help if you pay the fees ahead of time. That way you can say you are just waiting for the wedding certificate, fingerprints etc before you file to Mississauga.

I was unaware that we could do that! Oh wow, that would help out for sure.

Also, I thought that it took only 42 days for them to make a decision regarding as to weather or not they will let me stay [I'll be filling from inside Canada to extend my stay.] And that application must be sent 30 days prior to my departure date. Is that right?

No you can send it over night just a few days before May 10th if you rush mail it. Also if you apply to extend your stay that is to get a visitor record and by mail it takes at least a few months before they make their decision. As for applying for PR you can apply outland to Buffalo while still staying in Canada. If you apply online I think it is around 42 days. If you apply by mail it takes way longer. For the visitor record that is.

Like others have stated, it all depends on which IO you get. I have done what you are doing Many (20+) times without ever getting refused entry. Many times I stayed in the states less than 1 day. A couple times I crossed before submitting my application, but I brought my un-finished application with me (a huge file) so they could see that I was working on it, and had intention of filing. I was very honest with the IO's and told them that I was going to be living in Canada while waiting for my application to be processed. It always helped when I had my sponsor (common-law partner) with me. They seemed to hassle me less. The main thing they seemed to want to make sure was (1) that I wasn't going to be working and (2) that I had the financial ability to support myself while I was in Canada.

oh wow, so after printing off the application for PR and sponsorship [or even ordering it with prof of receipt] and showing my other progress with my medical stuff and police/FBI stuff [I sent it express and about a week ago and I believe it won't be back until after may I think.]

I'm mainly trying to avoid spending unnecessary money. That's the main thing, and the second think is spending more time away from my fiance.

So by sending it by mail how do I go about showing my prof? Will I have to put my unfinished applications and recites along with any other prof that I'm working on into that folder? Along with the normal: bank statement showing that I have funds to support myself and my fiances pay
stub(s) and my passport. I sent it in electronically last time, so I'll asume that it's different this time.

Right you send it off by mail and show proof of funds etc plus add anything you have to show good faith towards the application.

Let's make something clear here because I am confused by the thread title and original post. If, at any time, you leave Canada, your current status as a visitor is finished. When you re-enter (if allowed) it's a new permit. If you have applied for an extension to your visitor status and then leave Canada, there is no implied status. That extension application is now void.

Maybe you already understand this but I just wanted to be clear.

yes that's right, I just wanted to know if there is a waiting period, and then one question led to another and that's how the topic sorta changed. I didn't want to make multiple topics, or bring up my old topics the title would be misleading and I may also get misleading information.

thank you again everyone, you all have been such a great help
