Hi,

would I qualify for a open work permit under the family sponsorship, even though I`m under implied status (within 90 days after my visa expires) ? Is implied status for CIC legal status ? thank you for any help and anwers.

Your question is a bit confusing. Restoration and implied status are two different things. Implied status is something you have if (for example) you applied to extend your visit to Canada before your current visit expired. Restoration is when (for example) your allowed visit expired and you now have 90 days to restore your status.

What is your situation? What has happened and when? We'll only be able to answer your question if you provide more information.

thank you scylla for answering,

I am in Canada applying inland under spousal sponsorship. I already got a visa extension but unfortunately we could not send my application yet due to some financial problems. My visitor visa status expires at the end of next month and I`m not sure we will make it since then to send the application, we try really hard but I just want to prepare for the worst case. I think applying for an other visa extension makes no sense before July since I can not provide the proof yet that the application was sent and it wont look good in CICs eyes and I would risk of being denied a visa extension and have to leave. Thats why I thought, for in case we cant make it until end of July with the application, that I send after July a Restoration application and can then already include proof of payment, but I am not sure if I would qualify then for the work permit, which I really hope to get since we really badly need a second income. thank you again !

If you apply for PR after your visitor visa expires (and without applying for another extension), then you will be applying for PR while you are out of status and won't qualify for the OWP pilot. So if you want to qualify for the OWP pilot, you either need to submit your application before the end of July or extend your visitor status.

could I apply before July for an other visa extension and within the time I wait for the decision of the visa extension I send my PR application ? I would be under implied status then and would qualify for the work permit ? But what if my visa extension gets denied ? for in case that would happen, could I still wait for the outcome of my inland application ? Of course I would include also a copy of my visa extension application in the PR application, so that CIC sees that I care about having legal status. thank you very much for your very helping answers !
