hi Everyone,

I have a big problem, i had work visa for one year until march 15th, 2018, so i applied for extension work visa but on October 16th, 2018 arrived refusal letter.

I know that I can no longer restore my status and I can not apply for a visa, so I am illegal at this time because it has been much more than 90 days since my work visa expired on March 15th, 2018.

I have a Canadian couple a year ago, and we do not know if we can apply to common law because my status was lost. Is it possible to apply from Canada or is it necessary to leave Canada to try to restore status and then apply to a common law?

Please i need help,

Did the refusal say you have to leave? Did you apply for extension before it expired? You should call IRCC, 90 days should start from date of refusal of your extension application.

Sometimes the 90 days starts from the time the original work permit expired if the applicant didn't qualify for a work permit extension.

Yes- you can be sponsor for PR as common law while out of status (provided you have lived together continuously for at least one full year).
 
they tell me that the 90 days are from my expiration date of my work visa, I can not restore anymore and I have to leave
