I had a visitor record that expired in May 2020, I applied to restore my status as temporary resident and get a new record on August 2020 (less than 90 days after the expiration). Almost 8 months later, on March 28th, I got a letter refusing my application saying the following:
This letter refers to your application for a visitor record. Based on your application and accompanying documentation that you have provided, I have carefully considered all information and I am not satisfied that you meet the requirements of the Immigration and Refugee Protection Act and Regulations. Your application as requested is therefore refused. Persons wishing to extend temporary resident status in Canada must satisfy an officer that they will leave Canada by the end of the period authorized for their stay, that they will not contravene the conditions of entry and that they do not belong in a category of persons inadmissible to Canada under the Immigration and Refugee Protection Act. In reaching a decision, an officer considers several factors, which include the applicant’s: 1. Reason for original entry and reason for requested extension; 2. Ties to country of permanent residence, including: - employment and study commitments; - family ties and responsibilities; - status (citizenship or immigration status); 3. Financial means for the extended stay and return home; 4. Travel and identity documents; 5. Probability to leave Canada at the end of authorized stay. After considering all the circumstances of your case, I am not satisfied that you meet the requirements of the Act and Regulations. [X] A visitor, worker or student who loses temporary resident status for failure to comply with the following conditions imposed under: paragraph 185(a), any of subparagraphs 185(b)(i) to (iii), or paragraph 185(c) may be eligible for restoration of temporary resident status if an application is submitted within 90 days after loss of status and if following examination it is established that the applicant meets the initial requirements for their stay and has complied with any other conditions imposed. In your case, you are not a bonafide visitro; therefore you are not eligible to have your temporary resident status restored. Since you no longer hold temporary resident status in Canada your application for a visitor record is also refused.
It doesnt say anything else. If I have to leave the country (which I guess I have too since I dont have status) nor when. Now, I dont want to leave the country. I just moved in with my partner and we need to live together for a year so he can sponsor me as common-law. I had planned to get my visitor extension until we were able to do so. But it has been refused. What options do I have to stay in the country? Also due to the pandemic situation, I cant simply exit and come back. So I need a way to stay until my partner sponsors me.
