Hi -

So basically I (British) applied for Inland PR Sponsorship with my common law partner, through a consultant some months ago. However I have heard nothing from IRCC, I called and they had no information for me; I have also heard nothing from my consultant. Fearing the worst I am resubmitting my paperwork ASAP.

However I have long been out of status as a visitor, believing that this was all submitted months ago and believing that the long period of hearing nothing was due to Covid pushing back timelines. So my question is do I apply for a 'Restoration of Status' - IMM5708 with a detailed letter of explanation? Is there anything else I can do? Essentially I just need to maintain a visitor status until my application is processed.

Any help would be much appreciated!
 
First of all, it's very common that you haven't heard anything on your paper based application yet. Usually it takes about 3 months to get a AOR, but this year it would take at least 6 if you're lucky. Without an AOR there wouldn't be an application number then it's very normal the IRCC call center agent can't find any application details.
And secondly, you can just apply for the restoration, it's easy to do any you can do it online. Just get the application in before December ends.

Thank you so much for your swift response! I am looking into applying for restoration right now to ensure I submit before tomorrow. I just have a fear something untoward is going on as the consultant i used has gone AWOL and I don't want to get booted out of the country! Rather spend the $$ ensuring my status whilst my application is processed.

The usual limit for a restoration application is 90 days, but in 2020 such applications are given special treatments. If your status expired within the year, you have till the end of 2020 to submit an application to do the restoration, so you'd better hurry up and get it in before this year ends.

One more thing, for us working in the immigration business, it's kinda normal Not to contact a client when we got nothing to update. And I wouldn't recommend you to submit another sponsorship PR application when you haven't heard from IRCC since it may complicate with your original one. As for the restoration application, it's rather easy for you to do so I wouldn't waste any money on a consultant to do it. Anyone with common sense will be able to do the application. Just use the "Come to Canada" tool, answer some questions and you will be able to get a document checklist and most importantly, the reference number.

Thank you so much for all your help - I just have one last question - Back in 2016-2018 I was on an IEC visa and I applied for an extension whilst I attempted to get my PR via Express Entry (my university pratted about for far too long getting my certificate for me) and it was denied. I promptly left Canada and returned later on as a visitor.

For the question "Have you every been refused a visa/permit, denied entry or ordered to leave Canada or any other country or territory?" I answered honestly & wrote in the small allotted space a synopsis of what happened, is that ok? I thought it best to be honest but does applying for a Bridging Visa count? I feel I have answered my own question there lol but an expert opinion from you would be most assuring! Again, thank you.

You're absolutely right, it's always better to be honest with IRCC. If you lie to them they would eventually find out and that will jeopardize any future application. Also, I don't think it's gonna be a problem for you, I mean the refusal you had, as long as it wasn't for misrepresentation reason.

Public policy extended for temporary residents applying to restore status
Ottawa, December 31, 2020—Effective January 1, 2021, Immigration, Refugees and Citizenship Canada is renewing a temporary public policy that provides more time for temporary residents to apply to restore their legal status in Canada.
This public policy, which has been in place since July 2020 but was set to expire, recognizes that many temporary residents in Canada have been affected by worldwide health- and travel-related restrictions, and may need to remain in Canada for longer than they anticipated.
Under the public policy, visitors, students and workers whose valid temporary status expired, or expires, between January 30, 2020, and May 31, 2021, will have until August 31, 2021, to restore their status. In addition, the public policy will continue to allow former work permit holders applying for an employer-specific work permit to work while a decision on their restoration application is pending..
