I am a truck driver and cross US border frequently. I need to apply to Canadian Citizenship in 2015. I came to canada in Jan 2012.

Will they deduct days spent in the USA?

I am working for a Canadian company.
Please help

1. The new Citizenship Act clarifies that only physical presence (4 years in the 6 years prior to application) is considered in citizenship applications. However this section of the new act will not be implemented until July 2015.

2. So until July 2015 CIC still using 3 years of residence in the last 4 years prior to application where residence is not necessarily physical presence. If you apply with less than 1095 days of actual physical presence (APP) then you will be issued an RQ and have to see the CJ who has to decide what is so special about your application that you should be granted citizenship with less than the 3 years physical presence. This non routine processing timeline can stretch to +36 months!

3. Its a tough call for PRs in your situation but increasingly not having 1095 days APP often leads to the CJ refusing your application or if he/she accepts then CIC often appeal and most FC judges tend to side with CIC.

You may wish to check the citizenship residence calculator on CIC's website and decide based on the date it says you qualify to review your job situation. Alternatively apply as things are and explain your situation the day you meet the CJ!
