Hi All,

I'm sure this question has been asked multiple times but I can't find any previous threads so here it goes again. My wife and I applied for inland sponsorship back in early August and sent OWP application along (yes with the correct fee of $255). She's from a visa exempt country. I know that she will have implied status when her visitor status expires on Nov 15th, until a decision on her PR application is made. We weren't initially going to apply to extend her visitor status but when we thought about it a little more, we came to realize that if her applications were to be returned for whatever reason after Nov 15th, she would 1) lose her implied status 2) be ineligible to apply for an OWP until after we receive AIP. We don't have an AOR as of yet and by the looks of it won't get an OWP before Nov 15th (considering how slow things are moving). I spoke to the call center twice and both time got different answers (surprise surprise). The first time they told us that if we wanted to be safe, we could apply for an extension but the second time we were told to absolutely not apply because she has implied status. I did explain to the rep that we were worried that if our applications were returned after Nov 15th, we could lose the implied status and lose the privilege of applying for the OWP under the pilot project since she would be out of status. He told my that we could apply then to restore her status within 90 days...and then reapply...??? This is all very confusing and doesn't make sense to us :'(. Could someone please advise, share their opinions and if possible, their experience in a similar situation?

Hello,

The restoration fee is higher than the extension fee. So if you want to play it safe you can go ahead and apply to extend. I don't think it would hurt anything. You could possibly even withdraw that if you get the OWP before they start processing the extension.

If you feel sure that you've sent everything with your sponsorship application and that all documents are signed correctly, they shouldn't have any reason to return it.

So I'd say it's a matter of what you prefer :)
 
1. she is in implied status until she gets OWP or PR. (OWP takes unto 4 month - not sure this is correct though)
so she might get her OWP before her visitor status expired.

2. as Cedeel mentioned, she can renew her visitor visa and cancel it when she gets OWP.
I would apply for Paper app though, it gives her more time till gets her OWP( online processing time is bit faster than paper app.)

p.s Personally, I would not renew visitor status, but I 100% understand worry and anxious about app being returned and become illegal alien.
