Hello Everybody.

I'm married in paper but separated from my previous partner since September 2014, when I came to Canada. Now, I'm in a new relationship with a Canadian Citizen and living together since August 2015, planning to apply through family sponsorship as soon as we have lived together for one year. My previous visitors visa expired but I still have the study permit(exp. Nov 30 2016) since I'm a student here in Canada. Now I'm applying for a new visa to go back to my country in December and sign the divorce, my question is, since my partner and I are just living together for 3 months, in my relationship status should I put Legally separated or common-law? and in the questionnaire to determine my eligibily, should I answer yes to the question that I have a Canadian Citizen family member?
I really appreciate any help, I'm just afraid to answer that wrongly and screw up my family sponsorship application in the future.
Thank You!!!
